I'm no legal expert and I'm no gun nut, but it certainly appears to me that gun owners rights are under assault again. I'm referring of course to House Bill 45...otherwise known as the Blair Holt Licensing and Record of Sale Act. It was introduced by Representative Bobby Rush of Illinois. I tried to wade thru the entire bill but I think I get the gist of it...here's the highlights:

1.It will be "unlawful" to own a firearm without a license.

2.Getting a license thru the Attorney General would require a photo and thumbprint and passing a rigorous exam and mental evaluation and release of all mental health records.

3. Gun Owners would have to prove that their firearms are properly stored.

4. it would, in effect makes private sales illegal.

5, Establishes a Federal Record of Sale system which records make, model, serial number, license of the transferee and name and address of the transferor.

6. Provides for inspection of your home.

7. requires reporting of lost or stolen firearms

8. requires notice of change of address.

In my opinion this bill is so ridiculous that it would take a month to pick it apart bit by bit...so again... here's the highlights.

First and foremost the bulk of any laws that infringe on gun ownership will only effect law abiding citizens. Criminals who are already illegally in possession of firearms will love to see this become law because they know they'll meet less armed resistance from the law abiding citizens. Think for a minute how those "Gun Free Zones" are working out.

In the majority of other countries where gun ownership is outlawed, it all started with gun registration. They have to know who owns what, before they can confiscate it. Ask the folks in Britain how their gun control laws are working out.

This law would give the government access to come into your home at any time to see if you're properly storing your registered weapons. Are you kidding me? What's the 4th amendment there for?

I'm thinking that this bill is so ridiculous that it must be some sort of decoy. I believe that they'll come up with another bill that by comparison will seem downright reasonable and not as likely to cause as much concern...but then again what do I know??? Like I said I'm no legal expert nor am I a gun nut, but I do know ridiculous when I see it.

A rediculous bill. We as American citizens had better stand up for our rights and for own protection. This country better turn back to God before it is too late. Clean out both houses when election time comes around again. Get out and vote your convictions on the amendments, etc. We have rights or we did have!

What is the percentage of firearms that are involved in crimes are actually registered to the criminal that commited that crime ? This bill is preposterious.

He blew it off like it was not a big deal. He could not be prepared to have that important information on hand. Just so sad

When seconds count, police are only minutes away. Folks up north don't get it. If more of them stayed up north, this would not even be a question in Texas. When I got an e-mail about this, I thought surely this was a ploy to generate membership in the NRA. This is how far the insanity has gone. Thanks Gordon. Channel 10 is really kicking butt in Central Texas media.

Ridiculous? You're a fool. Point by point: 1. The first statment is the predicate for the rest. I.E. the license contains the evaluation of 2, 3 and 6. 2. You need evaluation. You can't assume that because someone can afford a weapon they can use it sensibly, that is to say without causing great physical harm to people or things. There is a privacy. But bottomline: Some people are too crazy to own guns. 3. How many stories have you heard about children finding their parents guns and killing either themselves or others? Keeping a loaded .45 in your nightstand is a terrible idea. 4. Not clear on the details. No rebuttle. 5. Ever noticed how people trade playin cards? And the goverment doesn't care? Becuase cards don't kill people. Simple. If they know where it came from maybe they can find it again after it was used to kill some innocent bystander (or policeman). 6. See 3. (There is a privacy issue, granted. But it seems unlikely to be a full inspection, only a safe inspection.

I think it's a way for the government to control us. Once they know where all the guns are and have made laws to support the gunowner having fewer rights, they can more easily come in and seize the weapons leaving America defensless to thier own government and folks who choose not to uphold the law. They will give this new bill enough leeway for folks to mess up and then promtly snatch up the right to bear arms at all. It is just one step further toward us losing our freedom. For the government, it is easier to control people with no defenses.

Why make a law that will not work. If you may getting guns diffecult people will get them illegally just like drugs. I will fight for the right to Bear Arms. I am a legal gun owner and will always protect my family and property from criminals. Stop triing to change the constution of the United States. Have better back ground checks!!! I will give up my rights to my guns when they pry my dead cold fingers from them.

I am retired military and a gun owner. Owning a gun is one of our rights. Check what happened in Australia when they took away most of the guns. Join the NRA.

This is a step to eventually rid us of firearms ownership. This and all other recent gun laws are disgusting. It seems to me the government can just strip our rights and do whatever the hell they want. This isn't 1930's/40's Germany but it's starting to smell like it. No gun laws change crime rates except the ones that are lifted. I wish I could actually speak to politicians and tell them that none of their laws are based on real world facts and it seems like they cover their ears and make noises like a child when we give them real statistics. "Assault weapons" are accountable for less than 1% of murder. The owners of these guns follow laws and guidelines rigidly and aren't the ones that should be attacked but are being attacked by these laws. Anti-gun individuals are full of fecal matter and they know it. Pro-gunners can do next to nothing to prevent these phony politicians from passing these laws. "Call your assemblyman or Senator." I'm sure we're calling in vain.

When it appears that any bill of that sort has a slight chance of passing I will simply call the Police and report all my weapons stolen just for the purpose of getting a Police Report showing that I have no regestered guns in the house anymore. Some people in other states have already started that process. Great Idea I believe.

HOUSE BILL 45; Introduced by some idiot;and pushed by a nut searhing for prase and glory!!!! Well, there's no glory in rewriteing the BILL OF RIGHTS; You don't have the nerve to fight for your country and preserve what our fore fathers gave thier lives for. And you darn well aren't going to get our guns!!!

I can not understand, what seems to be the obvious.....even with gun control, the people that we do not want to have guns, will get them no matter what controls are in place....they're criminals. The population that will be punished are the law abiding citizens that want guns for their protection from the criminals. It doesn't take a rocket scientist to figure this one out.

Dore, since your son is a deputy Sheriff, he'd probably be the first to tell you that, like Gordon said, the CRIMINALS are the "nuts" out there. This Gun Bill or any other Gun Control Bill for that matter will NOT stop a CRIMINAL from having a gun. How would your son feel about fighting crime/criminals without a firearm? Now, imagine no LEO OR LAW-ABIDING CITIZEN having a firearm but the criminals do. Your son is safe from the law abiding citizens that cherish our 2nd Amendment and want it protected from gun-grabbing, politicians. We've "abused right to bare arms long enough"? ARE YOU SERIOUS? When you say "we", who are you refering to, exactly? SPEAK FOR YOURSELF! IMO, it's a shame that WE have to vindicate our 2nd Amendment rights because of narrow-minded people like you, Dore.

This all sounds wonderful to me. My son is a Deputy Sheriff. You don't think I don't worry night and day about his saftey with all the nuts out there with guns? Less kids would get killed in their parents home due to not properly stored guns. A mental Evaluation what a great idea!! Virginia Tech may not have needed to happen. We have abused right to bear arms long enough. I am grateful for regulation.

Ken First of all thank you for the service you done for this once great country. No where does it say in the constituition that we have to earn the right. When I was in High School I made a bad choice to drink and drive and someone died. Now I Can't own a gun, but I can have as many cars, and buy as much beer as I want. (I Don't drink anymore.) I'm not a thug! I own my business, and teach Sunday School. So whats wrong with me owning a gun. Check the history. Our right to own guns is so we can't be taken over by Goverment.

Typically, television news programs and anchors spray us with easy to produce stories and tidbits that focus on car accidents, missing dogs, church suppers and leaking water mains. That an on-air personality would even come close to editorializing about a real issue such as gun control is as close to a journalism miracle as I can imagine. Drive on Gordon. With the looming bankruptcies of most newspapers, you may become a rare commodity.

While I find the KWTX blog entry pretty much on target, I thought that the television report at 5PM could have addressed the fact that owning and using a firearm is a constitutionally protected right. House Bill 45 is unconstitutional. Your commenter on the 5PM news show is wrong to state that guns are more dangerous than cars. Cars kill many more people in the US. And that is by accident. A criminal can kill numerous people with a car and can still own and operate a car after he gets out of prison. Owning and using a firearm is a right. Your television report did not even mention that owning a firearm is a right protected by the Constitution and affirmed in the recent Heller decision.

"(1) IN GENERAL- It shall be unlawful for any person other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector to possess a qualifying firearm on or after the applicable date, unless that person has been issued a firearm license" This comes straight from the proposed bill. I am not an importer, manufacturer, dealer or collector. I keep a revolver and a pistol for the protection of my person and my home. So...does this mean I can't be licensed? It doesn't say "register", it says only "licensed" people may own the guns. Therefore, if you are "licensed", they have the right to search where you store your guns. See Title IV, Sec.403

I do not believe that this bill would allow home searches. It does however allow for inspections of dealer premises for proper storage and record keeping. See Sec. 403. Inspections. Please read the text of the bill before commenting.

Where does it say the gov't can come into your home? Read the summary here: http://www.govtrack.us/congress/bill.xpd?bill=h111-45&tab=summary As I read it it says you have to register the gun, buy it only from a registered dealer. It's kinda like a car. I own a gun. It is not registered, it's grandfathered. But I have no problem with buying from a legit gun dealer rather than some thug selling out of the trunk of his car. Maybe rather than fanning the flames of outrage you could educate viewers about the bill in its own language rather than your interpretation thereof.

The 2nd amendment gives the right to the people to keep and bear arms. The 4th amendment protects the people from unreasonable search and seizure of their person or home. I agree with the gentlemen that wrote that the politicians trying to remove our constitutional rights should be removed from office BY THE PEOPLE! If you look at this Bill, gun owners would be subjected to the same inspection and registration policy as Child molesters. Maybe Representative Rush needs to get educated on who commits the crimes like that of the Lubby's restaurant. This is why the Texas concealed hand gun license law came into existence!! Law abiding citizens have a right to have a way of protecting themselves. IT IS A CONSTITUTIONAL RIGHT AND AS A VETERAN OF A FOREIGN WAR I EARNED THAT RIGHT!

These elitist idiots just make me sick. Sure, go ahead and disarm law abiding citizens so only the criminal element will be armed to exploit and victimize law abiding citizens. One very important FACT these idiots are forgetting is, THIS IS THE UNITED STATES OF AMERICA AND WE ARE AMERICANS. We have a wonderful Constitution written so carefully and thoughtfully to ensure the success,freedom and safety of a free Nation. If this madness does not stop, I fear citizen protest /revolt in the near future. Think of how many of us are many,many miles from law enforcement help. Rep. Bobby Rush of Illinois is just another thorn into the rights of law abiding gun owners. He and other anti-gun zealots prey on the ignorance of the uninformed populace because they know that the average person will believe WHAT THEY TELL THEM. The time has come to send a clear message that we law abiding gun owners and others who believe in our constitution should start bringing charges against the people who have demonstrated their true intentions -- to do away with our constitutional rights. Charges like violation of Oath of Office can be a start. Whatever your personal feelings are towards guns, this should not influence people in powerful positions to dictate law(s) that infringes on the 2nd Amendment and to law abiding citizens. They sweared before God and man that they will protect and defend the Constitution of the United States. Their very acts proves they are not doing this. Their immediate removal from office is definitely needed. The time to start removing them is NOW!

We knew it would not take long for this to happen. Gun control is always going to be shoved down our throats when the democrats have a majority. If you really want to do something to make this country safer, quit giving hardened criminials long sentences,and ways to stay on death row for years and years. Swift executions would clear out the prisons and also help out our budget.Controling the gun ownership by law-abiding (citizens)will only help the criminals.

Lawyers who attack individual rights forget one major primary reason that the founders of this nation included a right to carry firearms provison in the US Constitution. The primary purpose is to allow citizens the right to bear arms against tyrannical governments including ours.Once disramed the populace becomes subjects of the dictatorship. The founders of the US did not want that to happen. Neither do I. So, regardless of your personal feeelings about the ownership of guns , it is the right of citizens to protect themselves from tyrannical government including this current one. Remember Comminst China , Communist Russia , Nazi Germnany and 1176 before you push to give away my rights.
