BOSTON (February 2, 2010)--The U.S. Tax Court has ruled that a Massachusetts woman should be allowed to deduct the costs of her sex-change operation in a decision that could have wide-ranging implications.
Rhiannon O'Donnabhain, who was born a man, sued the Internal Revenue Service in 2007 after the agency disallowed a $5,000 deduction for $25,000 in medical expenses associated with the sex-change surgery.
The IRS said the surgery was cosmetic and not medically necessary.
But in its decision Tuesday, the tax court said the IRS position was rebutted by medical evidence presented at the Boston trial.
The legal group Gay and Lesbian Advocates and Defenders said the ruling could affect thousands of people a year in the U.S. who undergo similar operations.

What kind of country do we live in that a man has a sex change opertion to become a women (or surgically altered individual...but still biologically a man)and can get a $5,000 credit on their taxes for having the operation? I paid my taxes, but the man with a sex change operation doesn't have to. I just don't get it. Can this country get any more liberal these days?
So if I want a boob-job or a face-lift, is it deductible?
Correct Jim:Cove. How much more poop do we need to get our noses rubbed in???
