SAN BENITO (October 23, 2012)—San Benito Mayor Joe Hernandez turned himself in Tuesday to Cameron County authorities after he was named in a two-count indictment in a case involving a snow cone stand that operated on his property.

He was released after posting $5,000 bond.

Hernandez is charged with abuse of power and evidence tampering.

He declined to comment on the charges.

He’s accused of placing an ordinance revision on the city council agenda last year and participating in discussions of a change that would benefit him.

The second count accuses him of trying to obscure evidence of the snow cone stand, which was operating on his property counter to city rules.
