HOUSTON (March 9, 2010)--A state district judge in Houston has rescinded a highly criticized ruling that the death penalty was unconstitutional, but the debate on the issue isn't over.
State District Judge Kevin Fine said Tuesday he wants more information on whether the state's death penalty statute is unconstitutional because it allows for the possible execution of an innocent person.
During a court hearing, Fine took back last week's ruling, which he made in granting a pretrial motion in a capital murder case.
But he asked prosecutors and defense attorneys to submit motions on the issue.
A hearing in the case is set for April 27.
Fine's ruling drew criticism from a number of high-profile Texans, including Gov. Rick Perry.

Man, there a lot of dumb and ignorant comments about this judge. 1st question does anyone in here have a degree in law and passed the bar exam? Well then, there is a reason he is a judge and you are not. I've had two classes in government and one in philosophy and there is a whole lot more that goes into a LEGAL decision than your own personal feelings. Take a college level class and learn something.
I've said this for over 40 years;"What are we going to do when all of the pot heads, free love, flower child, peace Activists get old enough to get into Office"? Sounds like We are here!!! PERIOD!!!
The thing about this liberal judge is that he's on the side of the criminals. He knows too many of them as friends would be my guess. I'd bet that he has never sentenced anyone to the death chamber and never will. He's obviously in the wrong job. He's concerned with a criminal's rights, not the victim of crime and justice. This is what you get whenever a liberal is in office, coddle the criminals, ignore the victims, serve "justice" by giving out excuses for criminals.
