AUSTIN (March 12, 2010)--The Texas Supreme Court Friday threw out a $15.8 million civil trial judgment in a suit filed over a wreck that killed four members of a family in North Texas.

The court ruled unanimously Friday that lawyers improperly introduced evidence that the gravel truck driver blamed for the 2002 accident in Wise County was an illegal immigrant.

The justices said the introduction of that evidence was an attempt to inflame jurors' passions against the driver and his employer, TXI Transportation Co.

The court ordered a new trial while also handing a victory to the family of the victims.

The court ruled 7-1 that the family could reintroduce testimony from an accident reconstruction expert that blamed the crash on the truck driver.

Not only should the families be awarded large settlement money, but the owners of the company need to be charged with criminal negligence for hiring anyone that is not a citizen of this country in any position. I don't like to pay for scumbags to serve time in prison, but these guys need to be sent to prison for life without parole or given the death penalty. MY CHOICE - KILL THEM !!!!!!!! THE VERY IDEA OF GIVING A JOB TO AN ILLEGAL RATHER THAN A CITIZEN IS STUPID AND CRIMINAL.

Duh, didn't you read the story? The victims families have to go back to court again. It didn't say they don't get anything. And Yes, the judges are well aware of the drivers illegal status. What they're saying is that the way the evidence was improperly presented could have biased the jury to award more. Like anything in the legal world, you have to make sure your i's are dotted and t's crossed for it to be legally binding.

If i had of been on the Jury, I would have automatically awarded the deceased Family's heirs the 15.8 million from TXI simple because the Truck driver was an illegal immigrant who had 'no' business driving in Texas to begin with!! PERIOD!!!
