School District Investigates School Bus Sexual Assault Claim

MEXIA (September 2, 2010) - The Mexia Independent School District confirms its investigating an allegation a 5-year-old girl was sexually assaulted last week by a fellow student on a district school bus.

Mexia ISD Interim Superintendent John Turpin says the alleged incident occurred last week, and the district immediately launched an investigation after the alleged victim's mother contacted the district.

"Its not behavior we have ever had to deal with at the elementary level." Turpin told News 10.

Turpin declined to confirm the age of the suspect, only saying the boy was under 10-years-old.

"Worst nightmare, I never thought at 5-years-old, she would have to experience something like that." the alleged victim's mother, who asked not to be identified to protect her daughter, told News 10 on Thursday evening.

The district said it immediately had its police department launch an investigation, but because the student was under 10, criminal charges were not pursued.

In Texas, children under 10 years old are not criminally liable according to prosecutors consulted by News 10.

Turpin, with the district, said the student faces punishment, but he could not detail that punishment, citing school policies.

Turpin also said he consulted with school board members right after the incident, and the district decided not to send a note home to parents, believing the incident was isolated in nature.

Turpin says the Texas Department of Family and Protective Services was also notified about the alleged incident.

"I want to be able to protect those other children, I couldn't protect my daughter, but if I could stop it from happening to another child, that is, that is, well worth it." the alleged victim's mother said.

The reason we don't have extra people to baby sit the kids on the bus is the govt(Democrat or Republican) seems to think we need money for extra people. Our schools are having a tough enough time paying the people they have. In heavy traffic, do you want the bus driver watching the road or the kids. Hopefully, he or she can glance back once in a while but you might miss something like that.

yes that kid should be commited to austin state hospital . they might as well not have public education in my book its like prison so he learned that behavior in public school well its so close to prison conditions that im not suprised the bus driver are to face charges and this superintendent are to be fired for letting this happen on his watch to the mother of the daughter call vic feazell sue mexia isd for millions by the way if a boy done that to my daughter i dont care what age he is id break his neck and anyone who stands in my ways neck . i pray for that little girl

some people are so stupid why would you say that the mother is making this up she and her dauhter are going through a tough time an ignorant people like you come on here and say stupid stuff like that. and it did happen. the camera just dont work and the kid needs to be taken of the bus and have his parents pick him up and drop hime off every morning and have a close watch through the rest of his school years cause if i was the parent i would have made a bigger deal this isnt something you can just hide because how bout if the next time its worse
