(January 11, 2008)--The Lufkin Police Department says it did not violate open records laws by providing autopsy photos to a candidate for Angelina County sheriff.
Candidate Trent Burfine is also a Lufkin policeman.
He used the autopsy photos of the battered body of 15-year-old Candice Alexander on his campaign Web site.
A police spokesman says the key to public access of autopsy photos from criminal cases is usually that the case has ended in a conviction.
Burfine uses the photos to highlight what he says was the mishandling of the Alexander murder case by the Angelina County Sheriff's Office.
The girl's mother and stepfather were convicted of murder and sentenced to life in prison for the 2003 slaying.
Texas law allows police to keep evidence from the public while a possible crime is investigated.
Once a case ends in a conviction, that evidence becomes open record.
