Jury Sides With School District In Sexual Abuse Lawsuit
A jury sided with a Texas school district Wednesday in a lawsuit filed by a mother who said her daughter was sexually assaulted by a kindergarten classmate.

(January 16, 2008)--A federal jury sided with the Eanes ISD Wednesday after a mother said the school allowed her daughter to be sexually abused by a classmate.

The lawsuit against the Austin-area school district and an elementary school principal alleged the child was not protected from sexual assault by a kindergarten classmate.

Superintendent Nola Wellman says the district's standard for safety and well-being for students is important.

The Austin American-Statesman reports the suit claimed the girl, who was five at the time, was subjected to repeated sexual abuse by another girl during nap periods and on a playground.

The time frame was the 2005-2006 term.

The mother who filed the lawsuit left court without comment.
