(February 27, 2008)--A Texas death row inmate convicted of the slaying of an 80-year-old Dallas-area woman nearly two decades ago has won a new sentencing trial.

A federal appeals court has determined jurors at Charles Mines' 1989 trial were not allowed to properly consider his mental illness when they decided he should be executed.

Mines, now 58, was convicted of using a claw hammer to kill Vivian Moreno at her home in Waxahachie, south of Dallas

Frances Moreno, 57, one of the woman's 13 children, also was severely beaten in the same May 1988 attack.

In another death row case, the Texas Court of Criminal Appeals Wednesday upheld the conviction and sentence of a paroled
burglar condemned for killing three people at their Houston home.

Derrick Dewayne Charles confessed to strangling his 15-year-old
girlfriend, Myiesha Bennett; raping and strangling her 44-year-old mother, Brenda Bennett; and fatally beating her 77-year-old grandfather, Obie Lee Bennett.

Yep here we go, the mentally ill card. Give me a break! This guy is just "playing the game" like most of the others. I say his life needs to end in the same way as his victims.

Aren't all killers mentally ill in some fashion or another? A person would have to be to take another person's life in cold blood. I agree...ALL who kill in cold blooded murder should be accountable and responsible.

I don't care if he was mentally ill. He still killed an innocent woman and he should pay for that. I hate the way the system caters to "mentally ill" killers.

Does this mean if you have a mental illness you can commit cold blooded murder. Some one please explain our justice system to me.
