Prosecutors To Challenge Insanity Defense In Baby’s Murder Save Email Print

(March 6, 2008)--Prosecutors in Galveston plan to challenge a man's claims that he was insane when he put his infant daughter in a microwave last May.

Joshua Mauldin is scheduled to stand trial next week on charges that he placed 2-month old Ana in a microwave for 10 to 20 seconds.

Galveston County prosecutor Xochitl Vandiver says she intends to challenge Mauldin's insanity defense by showing a "pattern of lying, deceitfulness" about his criminal history.

Mauldin is also accused of punching the baby and putting her in a refrigerator and a hotel-room safe.

Ana was hospitalized for 11 days with burns on her hands and face and required two skin grafts.

She is now a year old.

If convicted of felony injury to a child, 20-year-old Mauldin faces a sentence ranging from probation to life in prison.

He is being held at the Galveston County Jail on a $250,000 bond.

Mauldin's wife, Eva, blamed Satan for his actions, saying the devil disapproved of her husband's efforts to become a preacher in Galveston.

Will heres another one that will get out in a few years or maybe live in a nice little room/access to weights/basketball/live and never regret! America was built with the beliefs of GOD, you dont like it, get the heck out. Just because the Government wants to please everyone,giving everyone the right to come and go,pray and dont pray,kill or be killed. The Government can go to(not heaven). America land of the free/free religion/free speech/free to carry guns/free to deal drugs/free to kill people/free to do whatever you want right?! Some people have way to much free, but what does the government do, what do the people of amercia do, let them claim insane or blame God. What ever happened, eye for eye! Unless people start standing up for themselves, the sorry ones will rule th world. What a great America that will be?!

Regarding the comments from Anonymous(Mar.9,@ 8:40)I agree that God should be a part of everyone's life in some way or another. But, if you will read the article titled "Tiny Texas Town Bewildered After Triple-Murder", I have to ask where was God in that family? They were heavily involved in the church. The wife played piano in a gospel band, the father was an ordained minister, the daughter that paricipated and planned their murder sang solo in the church 3 weeks before she killed them. It makes you wonder, is it all about whether or not God is in your life, or is it just simply teaching your children right from wrong and raising them in a way that they can grow up and be compassionate, caring and responsible adults? Too many children are given too many material things and get their way too much! All children should be taught what is important in life and how to make a life for themselves. But, that would be a perfect world and we all know nothing is perfect.

What is wrong with this world is we removed God from anything and eveything that offends. What happened to caring about those who He doesn't offend? If you look around and read about all these people losing it, maybe it is time we get HIM back into our lives. America is way different than it used to be. Our nation was founded on "In God We Trust" and when you downplay that (to those offended), this is what you get. I am just wondering how those offended by God ever outnumbered those who love Him?

For those of you who have only read this story, I read the story back when it first happened and was told in Houston news. Supposedly the mom and her mother were out of the hotel at the time this happened...But for her to take up for him, she should never be allowed even visitation with this child and should be commited herself. As for insanity, anyone who can do these kinds of things are insane and should never be allowed out in the population of innocent people, mostly children.

Looks they may have missed a word in the headline or something.....Think they meant to say- "Attempted murder" or something like that......But yeah, I agree they need to be looking at the mother as well as the father....I think the mother may have had something to do with it as well and if she didnt, where was she when all this took place, why didnt she try to stop him or call the police..if I were that baby's mother I would have probably knocked his head off his shoulders and called 911 to come get him too...I mean, come on!... putting an infant in a microwave, fridge and a safe! what could he have possibly been thinking??? It wasnt the devil and if he was trying to become a preacher and suppose to be a man of God, he wouldnt have done this in the first place..I say lock them both up and throw away the key..no probation..Give the baby to someone who will protect them with their life! God Bless you little one and hope you make a good recovery!

hey texan, Darla is correct, look a little closer yourself before you tell her too, the headline says "Prosecutors To Challene Insanity Defense in Baby's Murder", but then in the article, it states that the girl is now a year old.

Hey ,Darla read a little closer. He is charged with felony child endangerment and child abuse. I agree though they would be hauling off a dead man if I had been there. Sounds to me though like she is just as guilty as him. What is our world coming to? Bless this little angel.

Insanity was never an excuse to harm another person until the court system started looking at future elections and appointments instead of punishment offenders should be receiving. It seems that career advancement in the judicial system must go hand in hand with liberal decisions. I promote neither liberal or conservative views, but it seems we need to go back to punishment fitting the crime.

Not to downplay this horrendous crime in any way (If I were that woman, I probably would've called the police to haul his corpse away).. but how can he be charged with murder if there was no death? The baby's a year old, right? Meaning she (thankfully) survived. Maybe I missed something...?

Wow, it's really amazing how parents can kill or attempt to kill their children and claim insanity and get off. What does that say about this country? The insanity plea has become such an easy way out of anything nowdays. These are children that we as parents have a responsibility to protect. Yes it's a hard job. The hardest anyone will ever really face. If you can't do it then give the child to someone that can and will. There are many legitimate people out there that will take care of a child. Some just can't have their own and some have their hands full with what they have but would take yours if you felt you just couldn't do it. We as a country need to stop letting them plead that God told them to or that the Devil had something to do with it. Religion is not an excuse in any circumstance. Personally I believe if you kill your child then you should be put to death the same way. Why should an innocent child suffer horribly and the parent never experience what they did to their child.

SOUNDS TO ME THAT THE MOM HAS A COUPLE OF MISSING BRAIN CELLS ! THE BABY SHOULD BE TAKING AWAY FAR FAR AWAY FROM LOONEY TUNES LIKE THESE TWO !!! HOW MANY TIMES ARE WE GOING TO LET PEOPLE LIKE THIS USE THE EXCUSE THE DEVIL MADE ME DO IT OR GOD TOLD ME TOO COME ON NOW LAME EXCUSE , IF YOU HURT A CHILD YOU SHOULD BE PUT IN PRISION WITHOUT LETTING THIS MORONS OUT THROW AWAY THE KEY AND TELL THEM GOD TOLD ME TO PUT YOU AWAY FOR GOOD!!!!

I THINK THE HUSBAND SHOULD BE CONVICTED BECAUSE YOU DO NOT HAVE THE RIGHT TO PUT A BABY IN THE MICROWAVE.THAT IS MESSED UP OF SOMEONE TO DO THAT TO A BABY. PEOPLE THESE DAYS HAVE NO MORALES. PEOPLE WHO DO STUFF LIKE THAT SHOULD NOT BE HAVING NO CHILDREN IF YOUR JUST GOING TO ABUSE THEM.AND THE MOTHER CANT BE SAYING THAT THE REASON HE DID IT IS BEACAUSE THEY DID NOT LET HER HUSBAND BECOME A PREACHER THAT IS A LAME EXCUSE TO USE FOR WHAT HE DID TO THE BABY. MAYBE THE MOTHER HAD SOMETHING TO DO WITH IT AS WELL I THINK MAYBE THAT THEY SHOULD INVESTIGATE HER TO.
