Waco Federal Judge Disqualifies Texas Speaker’s Opponent
A federal judge Thursday has ruled that the Democrat who’s challenging Republican Texas House Speaker Tom Craddick in November is ineligible to run.

(April 17, 2008)--A federal judge Waco says Midland City Council member Bill Dingus is ineligible to challenge Texas House Speaker Tom Craddick for his Texas House seat.

U.S. District Judge Walter Smith said Dingus didn't resign his city council seat before filing his candidacy for the Legislature.

The Texas Democratic Party had asked a judge to weigh on the eligibility issue.

Dingus now says that if the state Democratic Party declares him ineligible, he will resign from the city council and ask the party's executive committee to select him as the replacement nominee later this week.

“Needless to say, we are very pleased with the decision,” said Texas Republican Party Chairman Tina Benkiser.

Craddick has held the Midland seat since 1969.

The 150-member chamber elects their leader to two-year terms when it convenes every other January.
