Appeals Court Upholds Ruling Overturning Yates’ Conviction
A state appeals court Wednesday upheld a lower court ruling that overturned the capital murder conviction of Andrea Yates, the woman accused of drowning her five children in a bathtub in 2001.

The Texas Court of Criminal Appeals refused Wednesday to reconsider a lower ruling that overturned the capital murder convictions of Andrea Yates.
A prosecutor says the case of the Houston woman, who in 2001 drowned her five children in a bathtub, will be retried, or a plea bargain will be considered.
Jurors rejected an insanity defense for Yates.
She was found guilty of two capital murder charges for three of the deaths.
Yates was sentenced to life in prison and is jailed at a psychiatric prison in East Texas.
Harris County Assistant District Attorney Alan Curry says Yates knew what she was doing and that it was wrong.
In January, the First Court of Appeals in Houston overturned the convictions because of false testimony from a forensic psychiatrist.
The appeals court Wednesday in Austin declined to review that ruling.
