Former Central Texas Officer Pleads Guilty Save Email Print

(May 21, 2008)—A former Georgetown police officer accused of raping a drunken woman while on duty in October has pleaded guilty in an agreement with prosecutors.

Jimmy Lewis Fennell, Jr., 35, pleaded guilty to one count of kidnapping and one count of improper sexual activity with a person in custody Tuesday in a plea deal that recommends two years in state jail for the improper sexual activity charge and 10 years probation for the kidnapping charge.

Formal sentencing is June 24 in Georgetown.

Fennell would have to surrender his peace officer's license, but won't have to register as a sex offender under the deal.

Fennell could not immediately be reached for comment.

He was fired in December, and then put back on paid administrative leave.

He resigned in January.

The charges brought renewed attention to the 1996 death of Fennell's fiancée.

He was a suspect in the strangling of 19-year-old Stacey Stites in Bastrop County until investigators ruled him out.

At the time, he was a Giddings policeman.

The slaying led to the 1998 conviction of Rodney Reed, who is on Texas death row.

At the March hearing, Reed's attorneys argued the actual killer was Fennell.

Reed's attorney Bryce Benjet told the Austin American-Statesman that Fennell's plea agreement is relevant to his client's appeals.

to anonynmous on may 23@1153 let's pray for your sake since you'll never " need a cop" that your family never has a crime happen to you like murder or RAPE, because they are the first ones to call on. madmax i am sorry that people feel this way about police officers, and i can say that with the personal experince of loosing a loved on at the hand of a police officer in 2000 but one bad seed as not tranished ya'lls name in my book thank you for trying to keeping our streets safe. As for this cop I am sure justice will be served at the gates of heaven. It is a little confusing why he doesnt have to register as a sex offender when he has been convicted of rape?!

To Cynthia, that's between you and the McGregor Police Department. I highly doubt that the Police Department killed your son... Hope you get some answers

This is the real story of my son's suspicious death in McGregor, that was NOT investigated by McGregor Police, telling me, "We don't begin an investigation until something suspicious is found." My then 19 year old son, gave his life only because he was not liked by the officers in McGregor! And although I didn't know what the "Blue Code" was then, I do now!

Cynthia, that's just a small percentage of Officers who truly do the job for the true reasons. Every profession has bad apples, but obviously if its a Police Officer, it just gets glorified on the news. To say that people join Law Enforcement only for a power trip is totally wrong. Why don't you visit www.odmp.org and you can see over 17000 Officers who gave their lives for people like you and me... Go read how some of these Officers died and you'll see there is no power trip...

This man is a complete sociopath...using Authority to get what he wants. My heart goes out to the rape victim in this case. Who knows what else he has done to other women or men. I believe since this was a sexual assault, regardless if he was a police officer, he should be upheld by Texas Law and required to register as a Sex Offender. I think the law has gave him ample enough opportunity to commit another sexual assault due to the fact that he was not indicted fairly.

HURRAY!!! This goes to show that even police officers are NOT above the Law! I believe that people become law enforcement, only because of the "power trip" they crave. Am I the only one that has taken note of the police corruption going on everywhere? Yet, these dirty cops are not receiving full punishment mandated by law. Why are these "humans with a badge" given special treatment? Keywords: Dirty Cops~You will be amazed!

How can someone plead guilty to rape and not be required to register as a sex offender???? Don't tell me peace officers don't get special treatment and a double standard when it comes to punishment.

this officer certainly tarnished the badge but on one hand, he wouldnt've got off so lightly if our legislators hadn't written the law where lawyers can help their guilty clients get off this way

Cops doing illegal things? No? (sacrcastically). This type of stuff always happens in the lower income neighborhoods. But the cops dont bother to investigate, I have seen drug dealers get busted with a certain amount and then only half of it is found in court. Either cops are helping the criminals or they are keeping some of the bust for themselves, i think the latter. He was a small fraction of the 40% of bad cops.

What a punk. I am sure there is a part of this story that will never be told to the general public. This is how things go. There is the truth and then there is what authorities believe the public can handle. I believe he did it since he pled guilty, but the light sentence and lengthy probabion would make me believe it would have been a tough case to prosecute. They still have him an a ten year hook with the probation. If he violates his probation and it is a good case, they will put it to him.

To anonymous, as stated below, he has definitely tarnished the badge.. He deserves to be punished harshly for what he did because he took advantage of a person, eventhough intoxicated, and abused his powers for his own sick pleasure. For the sentencing, I'm sure the victim probably agreed to it as most prosecutors consult with victims of crimes. I'm sure this lady didn't want to be dragged into court and face the accused, since that is his right. She probably agreed to the sentencing. Also, there might be more to the other half of the story. I'm definitely not saying the victim asked for this to happen to her, but maybe she consented at first, then said stopped, so that could be why he doesn't have to register, but I really could not elaborate on that part. Regardless, he abused his power and made the other 99 percent of good Officers look bad..

If you notice, most people get PROBATION for what he did. Most cops get a heavier punishment for breaking the law. The charge that he plead to was kidnapping and improper sexual activty.

Two years in a state jail & ten years probation doesn't seem like justice to me. If anyone else was convicted of that crime they would get more time. It sounds like somebody paid somebody off.

OK, so if it was anybody else, they would be in jail for life, why is he any different? Because he was a police officer? Because he plead out?
