(June 16, 2008)—A 5-year-old child who was ejected from an SUV that rolled over Monday morning on Interstate 35 was pronounced dead at the scene and a 59-year-old woman who was trapped in the wreckage was flown by helicopter to a local hospital with a severely lacerated foot.

The 28-year-old woman who was driving the SUV and five other children, ages 5 to 12, were taken by ambulance to Scott & White Hospital with less serious injuries.

The accident happened around 9 a.m. Monday in the northbound lanes of the Interstate in Troy, north of Temple.

Investigators said the driver of the SUV overcorrected in an attempt to avoid a collision and lost control of the vehicle.

The SUV veered off the highway and rolled several times.

Firefighters had to use the Jaws of Life to free the 59-year-old woman who was trapped in the front passenger seat, police said.

Names of the victims were not immediately released, but investigators said the driver of the SUV was from Dallas.

Why was that child not in a seat belt?

Posted by: CJ on Jun 17, 2008 at 10:03 AM
Until you know the facts, no one should make comments about how or why he died. I had a friend that was killed back in December by a drunk driver, along with 4 of her children. Two of them were ejected and they had seat belts on! The mom was ejected as well and she had her seat belt on, but the crash was so violent that it sheered off the passenger seat. She was found yards away from the wreckage, still IN her seat with the seatbelt. Don't use automatically assume that little Eric was not in a car seat and buckled in.

To Facts Please...I've read 4 different reports and I did not see anywhere that an officer "witnessed" this accident. It sounds like you have a beef with Troy police. People have to slow down..observe the speed limit when driving through that little stretch because it's dangerous! Veer means just that...like the 17 yr old yesterday that veered into a concrete barrier while playing on her ipod. One report did say that an officer believed she "may" have been switching lanes to avoid a collision, then tried to correct and lost control. It was not mentioned he personally "witnessed this". If there were less maniacs on the I35 like you, who won't observe speed limits, then maybe everyone would be a little safer.

I read in another news article that the child was strapped in a middle seatbelt with another child. Parents should really enforce seatbelts to their children and set good examples for them. My car does not move unless my kids seatbelts are buckled. But that is no reason (Teagan) to BLAME that child! Or anyone for that matter. Who are you to judge? This family is stricken with enough grief from the loss of their child, they don't need comments like that from the likes of you. My condolences to the family.

Read one report, wreck was witnessed by an officer. If he had his reds on, you are required by law to "veer" into other lane, usually causing dangerous turbulence to traffic flow, especially with a concrete divider you may be forced into. SOME 18 wheelers take great delight in doing this. Been there, done that, sorry. ("Veer" is how I-35 drivers interpret changing lanes to keep from getting a ticket.) To Steve: your small town law enforcement just might have something to do with all the accidents in that small strip you refer to...?

This is a tragedy!!! I hope that the family will find peace in the days ahead. While certainly it is hoped that all parents will buckle up their children. The reality is that a five year old can get out of almost anything you put them into. I have a five year old son, and I find myself stopping to put his buckle on occasionally after he takes it off. To Teagen, you must not have children, why would any one blame a child this young for something so horrible. They cannot process the concept of life threatening injury and death no matter how many times or how well you try to explain the importance of buckling up and staying buckled. It is just a tragic, tragic, horrible accident.

Please don't respond to idiots like Tegan. All you are doing is making them happy by getting a reaction. They know they are wrong, and it will come back to them one way or another. My prayers go out to the family.

TEGAN you are so stupid. How can you blame the kid, he didnt know any better. Are you really that dumb I cant believe you would say such a thing...

I am so sorry Aldo from dallas about Eric. For everyone else have some sympathy for this family always pointing the blame to someone it was an ACCIDENT, give the family a break they have lost a loved one now this 28 year pld female and all the other passengers have to deal with the why wasn't it me? May God Bless Eric's family and may he rest in peace. to his family please let it bring a little peace to you knowing eric is in heaven looking down upon you and will never leave your sides.

My prayers goes out to the family. My sister is related to the family in loss. God Bless everyone. Please let's secure our children every time even if we are just going around the block.

Everytime I drive to Killeen I see children standing in the back seats and not in a seatbelt or carseat, the parents are always buckled up though. Seatbelts save lives! They don't work unlesss you use them.

little guy's name was eric and he was my cousin, everybody else just had scratches and everybody else is fine

Children can be ejected from a car seat in a violent rollover crash. Heck, adults can be ejected when belted as well. Don't throw too many rocks till the facts are known. Condolences to the families invloved.

it was probaly the childs fault....i learned to buckle up at the age of five.

I live in Troy and there are always accidents in Troy along I-35. People assume since its a small town they can just drive like maniacs and not worry about our small town law enforcement. It is sad that at least once a month we have someone killed or seriously injured from an auto accident there just in the small strip of the interstate that runs through our small town. People really need to just slow down and watch out for one another so there will be no more tragedies such as this.

Man, another accident, why wasn't this child in the back seat.

Posted by: from 'round here Location: Gatesville on Jun 16, 2008 at 12:57 PM
Wow...that's basically all i've got. Why are we losing so many babies to car accidents? I am left to wonder if the child wasn't properly restrained due to the fact that he/she was ejected. My prayers are most definitely with the family...this is an incredibly difficult time!

was the child in a car seat??

Posted by: Anonymous on Jun 16, 2008 at 12:48 PM
I have seen so many small children that the parents just let bounce around on the seats or stand up so they can see out the windows. And I'm sure that there are many people out there that have seen this. This just makes me SICK to my stomach that the parents would let there children do this.

It's so disheartening to hear of so many children dying in motor accidents. To anyone and everyone, please drive safely in order to keep ourselves and especially our children safe.

That poor child what a tragedy. It doesn't sound like the child was in a car seat and if not this is why we need to have our children in these car seats. God bless this poor family.
