Local Man Sentenced To Life For Sexual Abuse Of Child

WACO (January 17, 2014) A Waco man who was found guilty a second time of sexually abusing a child was sentenced to life in prison Thursday.

A 19th District Court jury after only 10 minutes of deliberation found Jose Carmen Garcia, Jr., 32, guilty of indecency with a child by contact.

Because it was Garcia’s second conviction on a child sex abuse charge, state law prescribes an automatic sentence of life.

The previous conviction was in 2002 and Garcia served 5 years in prison on that charge.

The guilty verdict was Garcia’s fourth felony conviction, court records showed.

The Thursday verdict related to an incident from November 2010 during which a 6-year-old girl was abused at a residence in the 2400 block of Proctor Avenue, in Waco.

McLennan County Assistant District Attorney Michelle Voirin said after the verdict said she was pleased with the outcome.

"Jose Carmen Garcia is a registered sex offender who continued to prey on children in our community," Voirin said.

"We are pleased that this serial pedophile will finally spend the rest of his life behind bars."

Because the sentence was automatic there was no punishment phase in the trial and Judge Ralph Strother handed down Garcia’s sentence.
