Constable Could Lose Job After Being Caught With Pants Down Save Email Print

(July 17, 2008) - A Falls County constable's job is on the line after his peace officers license was suspended for the next ten years.

The suspension came after H.F. Westerman, Jr. was convicted of indecent exposure in April 2004.

During Westerman’s trial, the woman who reported the incident testified that she saw Westerman sitting on the passenger side of a truck on June 26, 2003, holding his underwear down with one hand and masturbating with the other.

She called 911.

During his trial, Westerman told jurors that he was in the parking lot that day, but his pants were only down because he had gas.

Westerman testified that he had driven to Waco that day to meet a woman with whom he was going to play bingo.

Before he left for Waco, he said he ate some chicken, which apparently upset his stomach, he said, so, he pulled into the grocery parking lot and went inside.

After using the restroom, Westerman said he purchased some Pepto-Bismol, a Dr. Pepper, and a bottle of water.

He testified that he went back to his truck and got in on the passenger side and sat there for a while because his stomach was still upset.

He testified that he loosened his belt and unbuttoned his pants because he was uncomfortable, and drank the bottle of Pepto-Bismol.

Westerman testified that perhaps Reyna saw him shaking the bottle of Pepto-Bismol, but denied ever pulling his underwear down or exposing himself.

On April 26, 2004, Westerman was convicted of indecent exposure and sentenced to 120 days in jail, fined $2000, and placed on probation for 18 months.

Westerman appealed the conviction to the 10th Court of Appeals, which upheld the verdict in December 2007.

As a result of the conviction, Westerman’s peace officer’s license was suspended in June.

According to the Texas Commission on Law Enforcement Officer Standards and Education, TCLOSE, that means he should no longer be able to hold office.

But Westerman's attorney says that because Westerman is an elected official, TCLOSE doesn't have the power to take his office.

Westerman is running unopposed for reelection as constable in November.

He has until July 23 to appeal the suspension of his license.

FYI--Check out the case file in the McLennan County Clerks Office. It should be public record. Then you people can form an opinion of your own. But from what I gather from some of the past messages, you would rather believe the worst in people just so you feel better about your sorry self. I wonder how many of you are in secure and have low self esteem. Personally, I don't think he got a fair trial.

He was at HEB in Waco not Falls Co. He's an elected Constable from 1 sector of the county so only those people would be voting on him & who says they would?Don't blame all of us because a FEW are defending him.As far as the County Jdg goes, he turned his firm over to Denny Lessman when he took office & I hear he's been trying to help shield Westerman so we can't trust him to do the right thing. The DA is good and she'll get the right thing done. Lessman is obviously an idiot, he said Westerman doesn't have to hold a peace officers license to do his job. Thats a lie because if someone is elected to a Constable position & doesn't have the license they HAVE to get it within 90 days or give up the position. We aren't ALL idiots in Falls Co, but the few that are make it rough on the rest of us, especially with people posting who don't have all the facts.Surely he'll have enough pride to step down on his own & surely no one will vote the Co Judge back into office after he's defended this man.

So if you are walking in a parking lot minding your business, how the heck do you see into a truck to see anything? He was on the passenger side with the door closed, how did this woman see him masturbating? Does she have xray vision or was she just wishful thinking?

Usually I am cynical, but I have to say his story sounds plausible. I think it's odd that he was convicted by what she says she saw. Surely she didn't stop and stare. She could have made a mistake.

Anybody who has Denny Lessmann representing them has a lot more problems than having his pants down in a parking lot. If he didn't have gas before he hired him, it's guarenteed he does now!!

I agree... accordint to my wife, sometime my gass should be eating thru my pants, so maybe he was trying to save those expensive uniform pants... that or he is just a pig that thought that "squeezing on off" in the store parking lot was okay cause who were they gonna call? him? i agree that he should have to register. if any of us were caught doing this, enen in our own back yard we would have to.
