Texas Loses Appeal To Ban Sex Toys Save Email Print

The 5th U.S. Circuit Court of Appeals in February had struck down the Texas law, which made it illegal to sell or promote obscene devices.

The attorney general sought a rehearing on the matter, decided by a panel of judges. The state argued that the full court should have a chance to rule, but the court turned down the request and said any appeal would have to be decided by the U.S. Supreme Court.

Abbott spokesman Tom Kelley said the state hasn't decided yet if it will appeal the ruling.

I am going to run to the neighborhood store and stock up on batteries....just in case. Our state has more pressing issues to deal with than sex toys. Using sex toys will not condemn me to hell; hate and ignorance will.Evil is how we treat one another;not a sex toy. Texas has one of the highest teen pregnancy rates, illiteracy, drop out rates in the country; sex toys didn't cause that....ignorance did.

Tom, I am glad you have the courage to stand up for what's proper and decent amongst all these misguided people. We know the dangers of letting our society model after Sodom. The Bible is clear on this. I feel like we are the only 2 righteous people left, and as the Bible stated, that's just not enough. Lot refused to give over the 2 angels, and we are refusing to give all of you over. But, I am afraid that when God sees the deviants and perverts that Texas is harboring, it may be too late. Hasn't Texas suffered enough? We've had 2 hurricanes in 2 weeks.....all warnings from God. If these warnings aren't heeded, and sin continues unchecked, THE NEXT POTENTIAL DISASTER WON'T BE A WARNING. The writing is on the walls and pages of the Bible. Enlighted, if you think the government should be able to control what we do in our bedrooms, why not in other parts of our lives. Control what kind of jobs we can have. Years ago, I knew a lady who bad-mouthed sex toys as, "tools of the devil". Of course, she was against sex in general and always preached about how awful people were when they had fun with their nasty little toys. My family had to help her move to another town one year. Guess what happened while her stuff was being moved??? You guessed it! A box fell, hit the floor, and out came some nasty sex toys. Gasp! The tools of the devil had somehow sneaked into her house while she wasn't looking! The best part was this happened right in front of her and several people. Needless to say, we didn't hear any more from her about sex toys ever again. I feel that one of the posters here doth protest too much, just like the lady we helped move!

I find it "obscene" that they wasted our tax money on this issue. What I do in my bedroom is my business and not the states or the governments. It's a good day for freedom and privacy. There are some things that government should keep their noses out of, and this definitely one of them. Luckily, the higher courts agree. What a man, woman, or couple decide to do in their own bedrooms is nobody's business. And adult shops only sell to customers over 18yrs old, well old enough to decide for themselves. If I was this guy Greg Abbott, I'd be ashamed to even have my name associated with such a facist attempt to impose government regulations in someone's bedroom. I know the real reason: It's an election year, and that kind of stuff goes over well with the intollerant religious right. Well, it didn't work on me, in fact I don't believe anyone with views like that would ever get anyones vote that I know.

Texans have been ordering sex toys through the mail (and via the web) for decades. If these items had been for sale in Texas, the state could have at least been making sales tax from every sale. It's not like these items are going to be for sale in HEB or Wal-Mart, for goodness sake! Texans will still have to go to specialty stores to get them. If you are a prude about things like this, then DON'T GO TO THE SPECIALTY STORES!
