Texas Man With Bullet In Head Acquitted Of Aggravated Assault
A jury Friday acquitted a 19-year-old Texas man on an aggravated assault charge that stemmed from a robbery during which he was shot in the head.

(August 22, 2008)--A jury Friday in Jefferson County acquitted a 19-year-old man on an aggravated assault charge that stemmed from a robbery that left him with a bullet lodged in his forehead.

Jurors deliberated for about 2-and-a-half hours Friday before returning the verdict in the trial of Joshua Adam Bush.

Bush pleaded guilty in May to charges of deadly conduct and aggravated assault of a witness to have four other felony charges dropped.

Most of the charges stemmed from a July 2006 robbery at a Port Arthur used car lot.

But Bush exploited a court error on June 14 to withdraw his plea and reject the plea deal, which could have sent him to prison for up to 10 years.

He faced only the first-degree assault charge in this week's trial, for which he could have received a life sentence if convicted.

Prosecutors say they don't yet know whether they'll proceed against him on other charges.

Police say Bush was part of a gang that broke into a Port Arthur used car lot and tried to steal vehicles.

Police said Bush tried to shoot the manager, but the man fired back, lodging a slug in the fatty tissue of Bush's forehead.

Bush claimed he was accidentally shot by a friend.

The case drew international attention when police wanted to remove the bullet from Bush's forehead over the objections of the teen and his lawyer.

Prosecutors eventually decided to try the case without the slug.

This is rediculous. The guy got out of a criminal sentence on a TECHNICALITY??? Becuase the courts would not order that the slug be taken out and examined because it was the criminal's personal property????? This is a miscarriage of justice, not justice! Then this punk gets away with the other crimes because he was aquitted on this one? (Garrunteed the DA won't prosecute the other crimes because the punks lawyer will claim double jepardy or the evidence won't be admisable due to his prior immunity or something like that.) Just another fine example of why Thomas Jefferson had it right..... Before you start any revolution, FIRST KILL ALL THE LAWYERS. Then the people will have justice and freedom. Too bad he the bullet didn't kill him. That would have been one less scumbag.

They should have strapped the punk down and cut the slug out. How much more does a jury need? Take a hammer and knock the slug where it should have gone and save tax payers money. This is outrageous!
