The National Weather Service has issued a RED FLAG WARNING in effect until 6 pm for Bell, Bosque, Coryell, Falls, Freestone, Hamilton, Hill, Lampasas, Leon, Limestone, McLennan, Milam, Mills, Navarro, Robertson, and Williamson counties in Central Texas. Attorney: Half-Ton Texas Woman Was Too Big To Kill Nephew Save Email Print

(August 27, 2008)--The attorney for a nearly half-ton Texas woman says the 1,000 pounds she's carrying makes it impossible for her to have beaten her nephew to death as authorities allege.

Mayra Rosales' defense attorney Sergio Valdez said his 27-year-old client lacks the movement in her arms to have killed the child.

He called it an "impossibility."

Mayra Rosales was indicted last week in the March 18 death of 2-year-old Eliseo Gonzalez Jr., who prosecutors say was hit twice in the head while his aunt was watching him.

The boy's mother, Jamie Rosales, is charged with injury to a child for leaving her son in the care of his bedridden aunt.

But Jamie Rosales is sticking up for her sister.

Her attorney says that she believes the death was possibly the result of the morbidly obese woman rolling onto the toddler.

A state district judge has agreed not to jail Mayra Rosales, provided she wears a global positioning system tracker until her trial because the county jail is unable to accommodate her size and medical conditions.

I'm not saying that this lady didn't kill the baby boy, I wasn't there! But what I am going to say is that some of these comments are crazy, how is someone going to sit there and make an assumption that the woman ate herself to be that big, did anyone ever take into consideration that this lady might have health problems that caused her to gain weight, yes I think that it wouldn't be the health problems alone, she may have ate wrong, heck I eat wrong and am having a hard time just losing 30 lbs. Don't be so quick to start judging, get some education and think about your comments!!

How about an alternative theory. Her sister did it. Then dangled a few twinkies and Ho Ho's in front of her face and told her that she should say she did it cause they would never be able to get her fat rear in jail and a jury would feel sorry for her....

I'm not fat either, but people usually don't weigh as much as a pickup truck because they eat right and exercise regularly.....don't pity the fat killer....pity the baby that was murdered.

Yeah....if she can lift her hand to her mouth to eat, she can use it to strike someone. Like I said before...grease her big &%@ up and slip her on through those prison doors...and let's not waste so much money feeding her every year, just strap her onto a California King-sized gurney and let the juices flow!!!

This has to be one of the most awful stories I've veer heard in my life. God bless the poor little baby boy. The mother obviously has no sense at all to leave him with that woman anyway. She SHOULD be prosecuted to the fullest for leaving him with her like that. Then the woman herself...can't lift her arms up??? My ass...If she can lift them up to put all that food in that she obviously eats, then she can pick them up to hit that little baby boy! she needs to be prosecuted to the fullest extent for what she's done. It shouldn't matter, either that there's "nowhere to put her' Thats crazy...Just because you're big, you don't have to go to jail? PUH LEEZE! whats next in this world? Somebody needs to think about what happened to the baby and punish these women the way they should be and don't just slap 'em on the wrist...thats surely NOT what happened to the baby. god bless his poor little soul.

People can do amazing things when they're angry enough. She evidently has SERIOUS issues to allow herself to get to that size. The little boy could easily have pushed her buttons and she hit him. I agree with William; if she can lift her arms to feed herself then she could hurt him. Sick excuse for a human being but she'll get what's coming to her eventually.

The M.E. will be able to tell all types of information about the injuries and if it is consistant with a whale attack or a coverup by a low life dumb(*& mother. And I am thinking that instead of a GPS tracker (I mean, how big are the straps on those things? Will they fit over her THANKLES? Thats Thigh and Ankles, not to be confused with Cankles) What they REALLY need to attach is a device that beeps when she moves or rolls over, like those devices on trucks and stuff...

I still think the mother(or someone else close to her) did it and is using the obese sister as an scapegoat! She probably told her that the boy was asleep and then blamed her when he was found dead! I would think that the M.E. would be able to differentiate being struck in the head and killed from being suffocated and killed. For instance were his ribs broken? If she rolled over on him, his ribs would be shattered from the weight because dont see her rolling over on just his head! Something is not right here! There needs to be justice for this child and hopefully the right person will pay!

I agree with William if she can feed herself (which it is apparent that she can) then she can strike a child. The second point I want to address is why was a child left with someone who is incapable of lifting themselves off a bed? A 2yr old can be a challenge to someone in good physical shape. I think mother should be held accountable as well for neglect. If this child was rolled upon he would have suffered from internal injuries not head trauma. As for a tracking device, that made me laugh. Where the Heck is this woman going to go? If the neighbors see a forklift & a Mac truck pull up call the laws. So let’s see if I understand the law now, you can leave your child in a hot car to die, or you can cry morbid obesity and get away with murder?

EXCUSE ME! I have a cousin live in Louisiana that weight well over 900 pounds.He still have great movement for his side.He might wobble when he walk.But that don't stop him from hurting some one. This woman is a sorry excuse for a woman. Don't tell me she couldn't kill some one!

So how in the heck did the little boy get the blows to the head. Eventhough they are saying she rolled over onto him that wouldn't cause such massive injuries to have killed him. If she had rolled on to him like they are saying then he would have suffocated or been smushed. That fat monster is just trying to get out of trouble. Stick her whale self in prison and leave her there. She needs to take responsibility for what she did instead of trying to make excuses thinking that because she is so fat that it is an excuse to not put her in jail. If that had happened to anyone else this wouldn't be up for discussion they would already be behind bars. This story makes me sick. That poor baby died; someone needs to be charged.

Yea right, if she can put that Triple Patty Burger with cheese, Extremely large fries and a diet coke up to her mouth then she can hit someone, the poor child was probably going for one of those french fries when she hit him.
