San Diego To Appeal Cross Ruling To U.S. Supreme Court
San Diego will ask the U.S. Supreme Court to review an order requiring the removal of a giant concrete cross from public property.

(June 25, 2006)--San Diego's city attorney says the city will petition the U.S. Supreme Court to review an order that a giant concrete cross be removed from public property.

On Wednesday, a three-judge panel denied San Diego's request to stay a judge's order that the cross be removed by Aug. 1.

Federal Judge Gordon Thompson Junior ruled that the city was unconstitutionally endorsing Christianity by maintaining the 29-foot cross in a municipal hilltop park.

He ordered the city to pay fines of $5,000 a day beginning Aug. 2 if the cross isn't removed.

Mayor Jerry Sanders, who decided to petition the Supreme Court, has said that if no legal relief is granted he'll remove the cross to prevent cash-strapped San Diego from incurring fines.
