Former Congressman Tom DeLay told a judge Monday in Austin that he’s no longer eligible to vote in Texas.

(June 26, 2006)--Former Texas Congressman Tom DeLay told a federal judge Monday in Austin that he now lives and votes in Alexandria, Va.

The testimony bolsters Republican Party arguments that the embattled ex-lawmaker from Sugar Land is ineligible to be on the November ballot for the 22nd District seat in the U.S. House.

The GOP wants to replace DeLay, who left Congress this month.

Republicans say they're permitted to do so under the state election law because DeLay has moved out of Texas.

But Democrats want to keep DeLay's name on ballot, to try to block any other Republican from replacing him.

The Democratic nominee is ex-Congressman Nick Lampson.

DeLay won his March primary, but quit the House facing tough opposition and campaign finance-related money-laundering charges.

He still faces trial in Austin.

DeLay says he's innocent.
