(November 17, 2008)—A visiting judge in Williamson County dismissed a misdemeanor DWI charge Monday against a retiring Republican state lawmaker.

Visiting Judge Chuck Miller dismissed the case against state Rep. Mike Krusee, who was arrested for erratic driving in April.

According to the arrest affidavit, the state trooper who arrested Krusee reported a "strong smell of alcohol" when he stopped Krusee's car and Krusee failed a field sobriety test.

The affidavit says Krusee refused a breath and blood test, so the trooper arrested him and booked him into the Williamson County Jail in Georgetown.

He was released the next morning.

Krusee's attorney, Jason Nassour, said the Williamson County Republican had only had one glass of wine at a friend's house.

Krusee carried and passed legislation in 2003 that created the driver responsibility program to help fund the Texas Mobility Fund, which has a number of surcharges for driving offenses, including $1,000 for a first drunken driving conviction.

To Anony,be advised the complete video is already on the net,and I have saved it just because it would have vanished forever if not.It should still be there,otherwise,I rest my case.The fact is, law enforcement(cops, judges,prosecuters,etc.)know to refuse everything.If you look,judges,cops,prosecuters,etc.are being arrested EVERYDAY FOR DWI.Not so funny thing is THEY ALL GET OFF SOMEHOW!!!I'm,currently seeking the outcome of the Hildogo county prosecuters(yes,there are two within a month or so,not to mention the judge,the judge got off by the way)and the records seem to have vanished(GO FIGURE).Still looking,maybe you can find it if you look hard enough.I just read an article about a tarrant judge driving 92 in a 65,refused everything.(did get mandatory blood draw,results not disclosed)but her lawyer is certain all is well.Hope you find what your looking for, and, wish me luck!!!

If you tell a cop that you've had ANYTHING at all to drink, you're going to jail. Refuse the breathalyzer and all field sobriety tests or else you give them evidence to use against. Say nothing lest you give them evidence. I had no record whatsoever and had two drinks and was arrested and had to plead no contest to DWI charges. It's already cost me almost $10,000 with about another $4,000 to go. Plus, I have a criminal record for life! I would love to get my hands on that video for Krussee. I'd post it on the web for the whole world to see. I wonder if the open records act would make it available?

I just read some of the comments in austin american statessman about how "sober" Mike Krusee looked on dps dash cam.Well, I suppose if almost falling over to the right during his one leg stand test,and flailing his right arm is acceptable,then I guess he passed.(by the way,when is that DPS cop going to be fired for deviation of procedure.)No one I know gets to cruise the front of a patrol car UNCUFFED AND USING A PERSONAL CELL PHONE!Whomever thinks he is innocent must be drunk too or otherwise impaired if you know what I mean!John Q. Public would be absolutely screwed in the same situation!What would you expect from a guy that would have gotten clemency anyway from Gov. Perry. Let's face it people,Krusee was drunk,and just got a "FREE PASS".

If that don't beat all. For all of us law abiding citizens, this feels like a punch in the stomach. Score one for "the man". I bet the trooper that stopped him feels like he got punched in the stomach too.

just viewed my video today.my bl. cont. clocked in at .23. I did 100% perfect compared to Krusee's.lawyer thinks i may win with jury trial.

Why has this lawmaker's case been dismissed. My son is currently serving a 7yr sentence for DWI and has been in prison for last 3 yrs. This is not the first for him -- second DWI he went to prison. Money and position talk!!!

The video tapes from the traffic stop and booking process should be available tp the public now that the case has been dismissed.

Well, there's a surprise. I wonder, if I failed a sobriety test and then refused to take any breath or blood alcohol tests, would I be exonerated if I weren't a lawmaker? Thank you for making sure another authority figure has a chance to get back on the road drunk and potentially KILL someone....

Some are above the law and some have no business on the bench! If he had only one drink than he would have passed the breath and blood test and most likely the field sobriety test. Only one reason why he refused breath or blood test. To set up a defense for his plead. We will never know, except the state trooper,the lawmaker and the all mighty. In God we trust, all others we don't.

So when did they start believing the old "I only had one glass" excuse? I bet there are tons of people who've tried that excuse and still got stuck paying the fine and doing the time. Doesn't seem fair.
