(November 17, 2008)—A state district judge in Fort Worth who was stopped for speeding on Interstate 35 has been named in misdemeanor DWI complaint based on the results of a blood test performed after she refused a field sobriety test.

State District Judge Elizabeth Berry was charged Friday after lab results showed her blood-alcohol level was above the state's legal limit of 0.08, although Johnson County Attorney Bill Moore declined to release the exact results because the case is pending.

If convicted, Berry, who’s judge of Tarrant County’s Criminal District Court No. 3, could be sentenced to up to 180 days in jail and fined $2,000.

She was free on $1,000 bond Monday.

Alvarado police say Berry was driving 92 mph in a 65-mph zone on Nov. 8 on Interstate 35.

After she refused to take a field sobriety test and breath test, authorities obtained a warrant to take a blood sample.

Berry’s attorney, Mark Daniel says they're more than prepared to defend against the case.

The Republican judge in Fort Worth is up for re-election in 2010.

I keep hearing about the Republican "family values", "moral majority" and "law and order" party. Baloney! I would say they should have the mantle of the "hypocrisy" party. This Ft. Worth Republican judge and so many of the "do as I say but not as I do" bunch from Florida to Idaho make a mockery of that self righteous, Bible thumping crowd called the GOP. Dems may not be the angelic party but they don't run around touting themselves as such. It is past time the Republican Party quit with the sanctimony and systematic efforts to cram their feigned religious dogma down the throats of Americans via the law books. Maybe Repubs should try to live up to the morality they screech about before trying to impose their "false values" on the rest of us!

Elizabeth Berry a drunk?!! Had to spend the night in the drunk tank, eh? This person is a bad example of a public servant and should be disbarred. For refusing the sobriety test and breath test - suspension of drivers license. Take an anger management course and do community service after serving jail time and paying the fine.

This just goes to show you how even persons in these types of positions, Judges, who's job is to pass judgement on other people can make mistakes too, after all we are only HUMAN, so hopefully everyone involved in any type of job that requires you to be able to pass judgement, stop and think, just my opinion.

This is just another example of an official who thinks they are above the law. Of course her attorney is ready to defend her, but not only was she over the legal limits, she was also driving at an excessive speed. Typical and disturbing.

This sort of thing doesn't surprise me at all. The outcome of this case should be very interesting...I'm willing to bet on a probated sentence.

I don't care who she is, if she refused the field sobriety test and breathalyzer then she needs to have her drivers license suspended and I would make her give up her position as a judge and disbar her.

Here we go again. The only way to stop dwi is to offer free rides all the time day and night so everyone who drinks can be assured a way home. Use the cigarette tax to pay for transportation. When the lawmakers are the ones now getting stopped (some dismissed and others a slap on the hand), it is time for some logical thinking on what needs to be done to protect the public. Obviously ticketing isn't working nor are huge fines. Maybe free counseling?

Hummmmm Above the legal limit, 95 in a 65 refused a sobriety test, Well if it was me I would be thrown in jail without Bond But Seeing how she is a judge that over rules the arresting officers observations and the radar gun, and also the dash video as well, But now she was arrested she is in the System Why is She Still A Judge? the things that make you go HUMMMMMMMM!!!!!
