Gun Advocates Lobby For Open-Carry Law Save Email Print

(November 30, 2008)—A group of gun advocates is lobbying state lawmakers for an open-carry law ahead of the start of the 2009 session of the Texas Legislature.

The advocates, who say the state’s concealed carry law is too restrictive, want lawmakers to allow Texans to carry handguns in plain view.

Supporters of "open-carry laws" have placed ads on billboards in Houston and San Antonio and on taxis in Austin.

The Texas campaign is expected to intensify Tuesday with radio spots in Fort Worth, Dallas, Houston, San Antonio and Austin that say, "We don't hide our colors, do we?" and encourages Texans to sign an online petition asking lawmakers to make Texas a place where people can openly wear their guns.

More than 28,000 people have signed it so far.

Texas is one of six states along with New York, Oklahoma, Arkansas, Florida and South Carolina in which handguns can't be worn in plain view.

The other 44 states, in the parlance of gun advocates, are known as "open-carry" states.

ISN'T IT AMAZING? THE ANTIGUN CROWD IS SCARED SPITLESS THAT SOME HONEST CITIZEN WHO HAS WORKED HARD AND FOLLOWED THE LAW THEIR ENTIRE LIFE MIGHT BE ARMED AND HAVE A GUN ON THEIR HIP. Meanwhile, they NEVER will admit that CRIMINALS ALWAYS ARE ARMED. They never look at Washington DC's history, Chicago's history (INCLUDING today's news that the cops were the main enforcers for drug dealers), or the rampant gun violence in gun banned Britain and Canada among other countries. The antigun crowd whines about their FEAR of HONEST people, those people who would be the first to step up and put their own lives on the line DEFENDING the weak kneed liberal antigun crowd. Sometimes, I think that the antigunners need to be shipped to an antigun city or state and DENIED the right to ever come to Texas again. Obama might "fix" the gun issue for the liberals, but he'll NEVER get Texans to give up their guns. We would fight and since we have guns it would be bloody. My rights are undeniable. PERIOD!

To my 50 cents: Been reading the Brady Campaign Against Gun Ownership again have you? Every time someone passes pro-gun laws, the Brady Bunch start hollering "WILD WEST SHOOTOUTS IN THE STREET"! They have been proven wrong every time. If open carry caused shootouts then 44 states would be having the shootouts daily. Fourty Four States already allow it. The ONLY places we have street shootouts is in the RESTRICTED ANTI-GUN STATES AND CITIES. Look at Chicago, Washington DC, New York, THE ENTIRE STATE OF CALIFORNIA....I could go on, but you obviously stopped reading when the truth was stated.

President Obama is going to take action, don't worry about that. Obama will punish law abiding gun owners, but do nothing to gun toting criminals. Obama will promise police protection, but never deliver. Obama will promise to cut taxes for the poor, but prices will soar and the poor will get poorer. I like having a conceled gun. I know in the summer it is hard to hide the gun. The law needs to be fixed so it would be easier for me to carry then. Everyone should not be able to carry. With my military background I feel that I am more than qualified to carry when and where I want to. If need be I will use my gun for my protection or for my family and friends. Keep the guns out of sight so some idoit will not shoot you, just because you have gun on. Please fix the concelment so it is easier for use to carry in the summer.

The proposed open carry law is not for everyone to carry anywhere. It will only apply to those who go to the trouble and expense of getting the CCW permit. At least this is how I have interpreted what I have read about the law. It only gives those with permits options for their right. As a CCW holder I really don't think I would carry open, but it would be nice to have the option in the summer. You can be arrested and charged with a crime if it isn't concealed enough and you can see the outline of it through the clothes. Today's holsters are also very well designed and can provide serious retention abilities. Some of the better ones all but totally prevent the gun from being pulled out unless proper procedures are followed. If carried open that may be the better solution to prevent the gun from being taken away by the bad guy.

I agree with 'lawman' that it should remain concealed so that there would not some bloat headed nut out there like 'BOB' walking round thinking he Matt Dillon of the world. Yeah, stick your gun out in the open like a goober and have some ex-con get the jump on you, yank your weapon out of its holster, and you find yourself on the ground with a dent in your skull, no money no gun. So what are you going to do... walk around everywhere you go with your sweaty palm wrapped around the hand stock, looking like a paranoid fool.

I agree with "Ryan." I would be in favor of open carry but don't know that I would use it much. It would be nice to be able to show it if I felt like I were in a threatening situation (being a woman who has a decent figure) and was alone. It would be easier to access if it were on my hip and not in my purse where I have to dig it out. But I also agree with those saying to TAKE CLASSES. Know how to properly handle it (and teach your kids gun safety too) before you display it. Also, I don't see that the open carry laws in the other 44 states have had adverse reactions so why not pass it here too?

I think that the Concealed or Open Carry Law should be the same way it is in Vermont and Alaska...NO LICENSE! The ONLY LICENSE we need is written in the US Constitution, the 2nd Amendment! We already carry concealed in vehicles without licenses. As for the ones worried about some nut with a gun on thier hip....think people! That same NUT is going to be bringing a gun out of their coat or purse (unlicensed concealed carry) and shoot someone anyway when ever they want to! By the way, I carry anytime I need to, does that make me dangerous? No! When I pull the gun out and shoot someone, THAT makes me dangerous! I carry a hunting rifle in the open, I carry a 12 gauge shotgun in the open. Why would me carrying a handgun of much lighter caliber and power suddenly be scary because it's on my hip? The fear is in your minds not the gun. A gun is no worse than the person using it. It is a tool, nothing more. NONE of my guns have jumped off a table, run outside, and shot anyone...EVER!

Their guns are in the open! The bad guys stole all their guns from the police right? After all those guns are all on the hip, readily accessible! Those were idiotic statements you made, the stupidist one was the "little guy" crack. Be honest, no cop wants to see a citizen armed because it lessens the cop's control over the citizen! As for why anyone would want to carry openly? 1) A rifle & shotgun is already legal in the open, a handgun should be too. 2) It's our right, see the 2nd Amendment. 3) If you have a CCW, and the wind opens your shirt, & the gun is seen; you get arrested & lose that precious CCW. 4) If the government gives you anything, it can take it back! The statement I use is simple: If you do not trust an honest man with a gun, what are you hiding or planning to do? Commit a crime?

Ok if the open carry law is passed then I hope that a course and back ground check will be required. I feel that if people who want to be responsible to carry a gun/weapon will do the responsible thing and take a weapons course. #1 this will make the persons carring their weapon more aware of their surroundings. #2 as a law enforcement officer I am required to qualify twice a year in order to continue to carry my side arm. #3 If we make the restrictions and requirements stricter this will prevent anyone from strapping on a "six shooter" who doesn't know the law. Also to the comment from "David" if a person does not have the money or ability to take a weapons safety course then they shouldn't be allowed to carry a weapon. This is not just for others safety, but for ones self safety also. I have seen to much tradedy over a kid or person who was not educated in gun safety.

I have to say I agree with George Thank about that a man with Driver Lic. that he passed the test to get to drive on our high ways said God said for him to hit that woman Now give him a lic. to carry a gun and what will God tell him next I mean if he can get a lic. to drive why not to carry a gun . Open carry for those who are licensed to carry a concealed weapon would allow everyone to know you are armed and licensed. Would truely put bad folks on notice, "Don't Mess With Texas". Would prevent lots of crime. But all should have to attend license to carry training no if, ands or buts about it.

To David; thanks for the link to sign the petition. I too am completely in favor of open carry. Suggest those with question as to the intent of the petition; go read it, short and sweet. Don't know many Texans that'd argue with the points made. I have a conceal permit too; worthless piece of paper/plastic in Texas. The training is of value for those far removed from common sense, otherwise, let's take the cost out of carrying weapons. What about guns not killing people don't we understand.

i can as an American soldier carry my weapon openly in someone elses country ,but I can not be trusted to do so as a law-abiding citizen in mine. I think if it is legalized, it can be a choice to carry open or not, or not at all.

LN & AL, you said well!! I don't have a problem with some kind of "choice" like the other 44 states have, OR, have the concealment laws restructured. The way the concealed carry law is written now, if someone sees a bulge in your coat pocket, you can be arrested as the concealment wasn't good enough to allow it NOT to be detected. That almost deters the "concealment carry." And when the weather is warm, (this IS Texas) any weapon you try to conceal would be too small to be of much help since the bad guys don't bother to conceal their big guns. (Run Diablow Run)... Texas is NOT becoming a safer place to live so why not join 95% of the rest of the nation?? When the CCP law was passed, everyone expected all hell to break loose and that didn't happen. So yes, if the wind blows your shirt up, no problem....

I have a chl.If given the option, I prefer it concealed. This way the advantage is in my favor. These thugs see a weapon than they are on equal ground for an attack but, if they can't see it, than I have the advantage. A weapon should be your last line of defense. Not a car, small lump of change, dispute, making a statement, etc. Only fear for your life and that will still cost you in a court of law. Show them off at a gun show, not a walmart. I can see a 90 year old fragile women carring a 45 on her hip, knowing fully well she can't protect it. Put it in a purse than it can get snatched. Hidden under her dress is another story. What a surprise she would make. Who would want to look there. A handgun in public sight may enhance a thug to go for the weapon. I watched offenders practice pretending taking guns out of the hands in the rec yards and they are quick and good at it.

I would like to see a law allowing for open carrying of s side arm. I have a concealed weapons permit now, but it hard for a female to hide a pistol during the summer time, and I'm sure that men have the same problem

They way I see it there are 2 types of people in this world. A. There are sheep. B. There are sheep dogs. Sheep think that we don't need guns and the law enforcement is all we need to protect ourselves. Sheep dogs know the system is broken and will protect our lives and property and neighbor's life and property by any means. I am a sheep dog. I am for either one. Personal choice should be afforded to everyone of us. If you don't want to conceal don't. All of you sheep need to sit in the pasture and let the dogs figure this out. Because one day there may be a wolf come knockin at your door and you will pray that there is a cop or a sheep dog to protect you from that wolf!!! As a 5', 110 lb female, I feel more confident with a concealed weapon. I've taken self defense classes but recognize - and accept - that I have physical limitations and could not go toe-to-toe with someone strung out on drugs or just plain desperate. I will continue to conceal my weapon. I support freedom of choice. But if we do this, I also believe we'd better give law enforcement officers wider authority to stop and search. And legislate to make the penalty for violations much heavier. I have a friend I dearly love - when he's taking his meds. When he isn't, I don't want anything to do with him and most certainly wouldn't want him to have a weapon. It's a shame we cannot legislate common sense!

I have had a conceal permit since it was legal. Too many people think that training and permits would go down the drain with open carry...just the opposite...at least I know where I can carry, what rules I have to follow before using deadly force, etc. Open or concealed should be a choice and I would almost bet most people would still carry concealed...but again they would have a choice...by the way, in the summer in Texas it's tough to carry concealed...

All of you who are belly aching about open carry causing mischief just because someone can see the gun are nuts. The ones who carry concealed would all of the sudden be emboldened to act like Joe Bubba Six Pack and shoot everyone in sight just because the gun is in the open now? Please. It has been proven by the DPS statistics that fewer than 1/10th of 1% of crime is commited by CCP holders. That is ALL crime, not just gun crimes. To think that just because it is in the open it will somehow transform into the OK Corral is just silly. Arizona, among other states, have had it for a long time and the arguements ya'll profess to happen were talked about then. And like here if enacted, nothing will happen. The same things were said when CCP was first proposed here, and nothing happened except people could protect themselves. I think it should pass and give the CCP holder the option. Plus if your weapon was exposed for some reason such as the wind blowing your shirt up, no problem.

I like the conceal carry law but wouldnt be opposed to open carry. But I do worry about the few idiots that would think this is the OK corral. But heck, they are probably the idiots already getting into trouble. As far as someone taking my gun from me? I dont think so. I conceal carry most every day that I can. I'm for open carry but I don't believe that I would use it too often. Mainly I would want it so I don't have to worry about printing too often. I was one of the first to sign the petition for Open Carry. A person with proper training shouldn't allow someone to take their weapon. If you carry, either concealed or open, take some classes for self defense. Don't be a victim.

I too am a law enforcement officer and highly disagree with open carry. The reason we don't have open carry is because a plain view weapon is an intimidator to others. I always carry my weapon in the open when off but keep it concealed for safety reasons. Think of how much more of a bully one may become. It also makes weapons too easy to be taken from the carrier. It will not deter someone from assaulting or robbing you if they want, they will just come up behind you, take your weapon and use it on you. Concealled carry is a better option since at least we know that person has gone through a through back ground check. If you adopt an open carry you have no idea who is authorized and who is not (Felon, etc). At least when I run a driver's license from my patrol car I now know the person may have a weapon and that he/she is licensed. Open carry is a bad idea!!

I personally support A open carry law and have Signed the Petition located at http://www.petitiononline.com/texasoc/petition.html and as a Correctional Officer for the State of Texas I know that Criminals are caring guns and they are looking for the weakest of our society to victimize they don’t care about the laws forbidding the possession of weapons. I was impressed by the news segments done by Stephanie Franks on women and guns that was hear a on kwtx.com A while back this isn’t A issue that concerns most people and it shouldn’t be but for those law abiding citizens that wish to be able to defend themselves and there loved ones and haven’t gotten a conceal carry license because they don’t have A credit card Or can’t afford the 140 dollars for the license. I am a police officer and I agree with the concealed hand gun law, but there is to many trigger happy people in this world. Guns don't kill people, people kill people. If you make your weapon accessable to the public this is asking for a incident to happen. As a law enforcement officer we are taught to protect our weapon at all times and given the proper training to protect our weapons. Whatever the decision I just hope that people are cautious. To many people lose their lives over gun stupity.

Most officers of the law have stated that they would rather it be "open carry" for obvious reasons. I too am in favor of the open carry. If you want to conceal then you can, if you prefer to carry on your belt you can. It personal choice. It has nothing to do with going back to the wild west, its a matter of personal choice. To El Diablo, do you really think the punks in the world are going to jump someone that is armed? I don't think so, there cowards and look for those who cant defend themselves, and to Spock, its easy to see your an anti gunner and must be willing to be a victim all of your life. I have the right as a police officer to carry my weapon in almost every place I go. I prefer to have it concealed. I can't see any reason to carry it in the open when not on duty & even then I rather not be noticed. If this is what the lobby is trying to get approved, then the ones carrying in the open are just suffering from a lack of self esteem (nice way of saying...little man's syndrome). Besides, how are you gonna shot the bad guy if he knows where your weapon is?

As for the open-carry law, I'm not sure where I stand on it, I like the concealed law as I can carry and no one knows, but it's too restrictive and tends to be a pain to fully conceal a handgun in hot weather and such. I guess I'd say I'm in the middle, I neither oppose it or approve of it.

Nope, we don't need this. the concealed law is fine. I think the concealed law already gives people that subliminal confidence and security. To advertise to everybody and to kids and teenagers is pushing it too far. I mean for example some people who drive those big trucks and suvs have a false sense of security thinking that because their vehicle is bigger than others that others will be intimidated on the road, or that you have to purposely give them space. An open carry law would really have the same effect. As if to say look I have a pistol, you better not look at me too long or look at me the wrong way. That could still happen with a concealed weapon, but the difference is that the pistols aren't just out in the open as if to visibly advertise a challenge. Besides all this, how would the Texas lawmen police the actions of people with an open carry law? I think its a bad idea. Let's just stick with the concealed law. It let's me carry my pistol, and nobody knows I have it.

I don't see anything wrong with concealed carry. It's enough for me. I just wish there weren't so many restrictions on places.
