(December 5, 2008)--A19-year-Texas old man should have been behind bars, but instead through a series of legal missteps was free when a 13-month-old toddler was murdered this week, the Tyler Morning Telegraph reports.

Blaine Milam, as part of a condition of probation for a second-degree felony, was sentenced in August to serve 180 days in jail and if the sentence had been followed, he should have been behind bars until February.

He and Jessica Carson, 18, were arrested Tuesday on capital murder charges for in the beating death of Carson’s 13-month-old daughter during what evidently was an exorcism.

Investigators think the couple used a hammer to "beat the demons out" of the toddler.

Authorities said Amora Bain Carson, was also bitten more than 20 times.

Carson and Milam remained in jail Friday in lieu of a $2 million bond each.

Officials also confirmed that Milam had failed to register as a sex offender in Rusk County and had not changed his previous address from Longview.
