(December 17, 2008)—A hearing is scheduled Thursday on a motion to dismiss a wrongful death lawsuit against former Waco-area pastor Matt Baker, who was arrested in September 2007 and charged in the death of his 31-year-old wife Kari.

The charge was dropped in March.

McLennan County Justice of the Peace Billy Martin signed the dismissal order at the request of Baker’s attorney because the McLennan County District Attorney’s Office had not sought an indictment within the required 180 days of Baker’s arrest.

Kari Baker died in April 2006 in the couple’s Hewitt home.

The affidavit filed in support of the 2007 arrest warrant alleged Baker slipped his wife crushed sleeping pills, and then suffocated her after she lost consciousness.

Kari Baker’s parents, who dropped their original wrongful death suit against their daughter’s husband in October 2007, filed a new suit in March on behalf of Kari Baker’s mother, Linda Dulin.

In the motion seeking dismissal of the suit, however, Baker’s attorney cites a sworn affidavit in which Baker says, “I did not assault my wife. I did not cause my wife’s death. I did not poison her. I did not give her medications and I did not smother her” and statements by Kari Baker’s parents during sworn depositions that they don’t have evidence of Matt Baker’s guilt,

That evidence, the motion says, proves Baker “did not cause his wife’s death.”

The hearing on the motion is scheduled for 1:30 p.m. Thursday in 19th District Court.

WOW,loose someone you love the way Kari's family lost her and then tell someone to "get over it". I had many conversations with Matt prior to Kari's death and not once did he mention that his wife was stuck in this great depression. Most centered around him. He was more than willing to share after her death how he was the main care giver and she was in a deep depression. It is not that this family doesnt want to "get over it". They feel that their daughter died under suspicious conditions. The Dulin's refiled their suit when Matt was not charged. They want to make sure that the possible killer isn't set free. Would you not fight tooth and nail for your child? I pray that the truth will come out and those children will be allowed to spend time with their grandparents and really know the person their mother was. The children are the ones that stand to lose everything. They have lost one parent and a sister to death. What else are they to lose. Pray for them.

Keri is at peace...she's in Heaven! They have plenty of evidence. The police botched the investigation at the beginning. They didn't even go out to the house when it was called in. They had to exhume the body to get forensic evidence. The whole investigation was botched at the beginning. Those forsensic reports are slow coming in. Let's wait and see what the true evidence says.

what about him stealing the computer at his job and switching it out with another? he killed her, there is more to this story. i know he was talking to a co worker about this right after the fbi was looking for the missing computer... there is more to this story way more than he's pretending.

Anyone who truly knew Kari would know that she suffered from deep depression every year at the time of Cassidy's death. Matt loved Kari and her parents should know that. Let Kari rest in peace and let her girls and Matt live in peace.

There were just too many pieces of evidence pointing to this man's guilt. He will be getting away with murder. My prayer goes to the Dulins...that justice may be served.

Oh, get over it, if they had enough evidence to convict him he would be in jail. Wrongful death suit, what for? Thats not going to bring their daughter back, matter of fact, them pro longing this issue keeps an open wound. Let the police do there job, if they arrest him file your suit then, until then let her rest in peace.

Anyone who has heard the story knows this man killed his wife because he was cheating on her! I hope they will convict him someday and give the family some justice!

Justice for Kari. A good friend of mine had Kari at MCC the semester she died. She told me Kari came to class every day very happy and upbeat. She was the brightest person. As soon as she learned of Kari's death, she immediately knew that Matt Baker did this. Why would someone so happy and bubbly take their own life? I really hope his conscience gets the best of him! I hope the Dulin's continue to pursue this. Maybe Matt will crack and admit his guilt.
