MEXIA (June 24, 2009)--Funeral services have been scheduled for a 5-year-old Mexia boy who wanted to be a police officer and was looking forward to starting Kindergarten this year, but who instead died after he was beaten with a belt while in the care of his uncle.
Services for Sinsear Jaywon Kirvin will be at 1 p.m. Saturday at the First Baptist Church in Mexia.
Burial follows at Cedar Hill Cemetery on Highway 84 west of Mexia.
Visitation is Friday from 10 a.m. until 8 p.m. and a wake will be held from 6 p.m. until 8 p.m. Friday at the Pearly Gates Funeral Home in Mexia.
Sinsear is survived by his mother, Brandi Mack, father, Marvin Kirvin, stepfather Craig Bender, sister Brynika Cooper and brothers Contrevion Bender and Marcavion Bender.
The boy’s uncle Christopher Mack, 22, and Mack’s girlfriend, Andrea Thomas, 24, remained in custody Wednesday, charged with capital murder and aggravated assault in the attack that left Sinsear dead and the youngster’s 3- and 4-year-old brothers injured.
The 3-year-old was treated and later released.
The 4-year-old did not require hospital treatment.
According to the affidavit submitted for an arrest warrant, Sinsear was beaten with a belt and suffered bruises, abrasions and lacerations to his head, arms, front, back, and legs.
Mack originally claimed the boy had collapsed, but the affidavit says, “Upon further investigation, a witness stated that Mack began striking Sinsear) with a belt until the (Sinsear) passed out and was not moving.”
Thomas was also present when the incident occurred sometime before 11:30 p.m. Sunday at the apartment Mack and Thomas share on East Crest Drive in Lacy-Lakeview, police said, but made no effort to intervene or seek medical help, according to the arrest affidavit.
Mack got a ride to the Providence Health Center emergency room from a friend and took both boys to the hospital.
Sinsear was pronounced dead at the hospital and according to the arrest affidavit medical personnel told police he had been dead for an hour before he arrived at the hospital.
The hospital notified police of the injuries.
Child Protective Services has taken custody of the younger boys, police said, and is assisting in the investigation.
