Waco Man Won't Stand Trial for Shooting Officer
A Waco man who is accused of shooting a police officer has been determined incompetant to stand trial for the shooting

WACO (August 5, 2009)-Retired Judge George Allen, sitting as visiting judge in 54th District Court in Waco on Wednesday, ruled Noy Moten Jr., is not competent to stand trial for shooting a Waco Police Officer in September, 2007.

Moten was accused and arrested for shooting Waco Police Officer Craig Mrosko following a disturbance in East Waco.

Police said Moten, 59, opened fire on officers at about 1 a.m. as they arrived to investigate a disturbance at 1124 J.J. Flewellen Dr.

Police returned fire on Moten striking him multiple times.

Craig Mrosko was a two-year veteran of the department at the time of the shooting.

He was treated at Hillcrest Baptist Medical Center for his wounds and released later in the day.

The other officer involved in the shooting was Tyrone Robinson, a 17-year department veteran.

Evaluation: (1)Patient competent enough to obtain handgun. (2)Patient competent enough to load handgun. (3)Patient competent enough to get into gun battle with police officers and shoot one of two officers. Finding: Patient competent enough to have be tried and if found guilty have his A#% FRIED for his action!
