WACO (September 18, 2009)-Attorneys for the state and defense were set to present a list of pretrial motions Friday in the capital murder case of Jeremy Lowrey, 24, of Hill County, but the hearing as postponed until Oct. 23 after defense attorneys asked for a continuance.

The delay means the trial will be in February rather than in November, as originally planned.

Lowrey is charged in connection with the October 2008 stabbing death of Rebecca Leonard, 52, who was killed during a home invasion in the 3900 block of Watt Ave. in Waco.

Lowrey was also indicted for attempted capital murder in an attack on Leonard's boyfriend, Jerry Patterson.

Lowrey was jailed after his arrest on bonds totaling $12.5 million, $7.5 million on a charge of capital murder and $5 million on a charge of attempted capital murder.

The woman who reported the incident, Yolanda Leonard, 34, told officers she woke up to find her ex-boyfriend in her bedroom.

She told police that her mother and her mother's boyfriend, Jerry Patterson, 67, entered the bedroom and were attacked by the knife-wielding assailant who fled before police arrived.

Rebecca Leonard died at the scene.

Patterson was taken to Hillcrest Baptist Medical Center where he underwent emergency surgery.

Officers arrested Lowrey later that morning near the intersection of West Waco Drive and North 42nd Street.

Too bad people like him aren't taken to a field and tortured to death by knife or gun starting at their toes and slowly working up. Instead of paying lawyers to do what they can to save them. TIncluding "Wheat" as well with the 4 yr old ggirl.
