Gag Order Imposed In Case Of Waco Man Charged In Boy's Beating Death
A state district judge imposed a gag order Friday in the case of a Waco man accused of beating his 5-year-old nephew to death with a belt.

WACO (October 9, 2009)—State District Judge Matt Johnson imposed a gag order Friday in the case of Christopher Mack, 22, of Waco, who’s charged with capital murder in the June beating death of his 5-year-old nephew Sinsear Jaywon Kirvin of Mexia.

The McLennan County Grand Jury handed up indictments in August against Mack charging capital murder and three counts of injury of a child.

Grand jurors indicted Mack’s girlfriend, Andrea Shante Thomas, 24, on three counts of injury to a child.

Johnson imposed the gag order during a brief meeting Friday morning with prosecutors and defense attorneys.

Another pretrial hearing in the case was scheduled for Nov. 20.

The boy was beaten with a belt and suffered bruises, abrasions and lacerations to his head, arms, front, back, and legs in June at an apartment on East Crest Drive in Lacy-Lakeview that Mack and Thomas shared.

His 3- and 4-year-old brothers were injured.

The 4-year-old did not require hospital treatment.

According to an arrest affidavit, Mack got a ride to the Providence Health Center emergency room from a friend and took Sinsear and hs brother to the hospital.

Sinsear was pronounced dead at the hospital and according to the arrest affidavit medical personnel told police he had been dead for an hour before he arrived at the hospital.

The hospital notified police of the injuries.

I believe in punishment, but really people what does it solved to take his life. He gets off scott free with lethal and the chair. Let him suffer in prison. If he has a heart and soul he already suffering within himself. He will have nightmares. That's up to the jury now.

Fry him, or lethal injection..whatever they do nowadays...where is the justice? The justice for this little boy...God rest his soul...punishment for the piece of trashy scum this guy is, he doesn't deserve to take another breath.

HE WILL GET HIS BEATING IN PRISON... THAT IS ONE THING THEY DON'T PUT UP WITH. HE WILL HAVE TO DEAL WITH THAT EVERYDAY OF HIS LIFE.
