Deliveryman Sues Local Woman Over Pit Bull Attack

GATESVILLE (October 19, 2009)--A deliveryman is suing a Copperas Cove woman in 52nd District Court in Gatesville, alleging that her pit bull attacked and injured him as he tried to make a delivery.

Mark Williams is suing for an unspecified amount to cover personal injury and his medical bills that arose from a July 3, 2007 pit bull attack.

Williams' attorney, Clifford Wilson, of Houston, says his client was attacked and injured when Williams went into the yard at Ella Avery's house to deliver a package.

The court pleading indicates Williams entered the yard at 206 E. Ave. A, in Copperas Cove, and was attacked by a pit bull that was staying in the garage.

William and his lawyer contend the dog was not properly restrained.

Avery's attorney, Brett Payne, of Austin, says the dog was only protecting its property.

Judge Trent Farrell seated a jury on Monday morning and testimony began after lunch on Monday.
