SAN ANTONIO (November 12, 2009)—A Jury will decide whether a Texas woman accused of dismembering her 3-week-old son is competent to stand trial.

Otty Sanchez appeared in court Thursday for the first time since she was charged with capital murder in the July death of her first born.

Prosecutors are seeking the death penalty.

Ed Camara, Sanchez's attorney, said he received a medical report Tuesday indicating that the 33-year-old mother's mental condition is deteriorating.

He said earlier he did not plan to contest her ability to stand trial.

A Bexar County judge ruled that a jury will now decide the issue.

A date for the hearing was not immediately set.
