HUNTSVILLE (November 17, 2009)--Condemned Texas killer Gerald Eldridge, 45, who prosecutors said was faking mental illness to avoid execution won an 11th hour reprieve from a federal judge Tuesday, less than two hours before was to have been taken to the state’s death chamber.
His attorneys contended he was too mentally ill to be executed.
Eldridge was convicted of capital murder in the January 1993 shooting spree that claimed the lives of his former girlfriend Cynthia Bogany, 28, and her 6-year-old daughter, Chirissa.
The shooting left two others injured; Terrell Bogany, Eldridge's 7-year-old son with Bogany, and the woman's boyfriend at the time, Wayne Dotson.
Eldridge's lawyers argued in appeals that he is delusional and clueless about his punishment.
The U.S. Supreme Court has held that prisoners must be aware of their punishment to be eligible for execution.
He was the first of three convicted killers schedule dto die this week in Huntsville.
