I don't see how he can get 'a fair trial'. There is not enough folks who have not seen the footage, read the news, etc. Then again, 'Fair' to me would more closely be to execute him immediately. He earned his death penalty by killing one. Shame we can't rinse and repeat 13 times. The victims are going to have to share their justice.

Anybody else see the cover of TIME magazine? And To all that say 14, I must agree. Give this muslim terrorist (is chairman Obama muslim?) a speedy trial and then bring back either hanging or firing squad. He doesnt deserve anything gentler. Yes, I am a firm believer in the death penalty and capital punishment. If convicted beyond a reasonable doubt, dont wait. Take them outside and kill them!!!

They need to stop treating him like a wounded victim and treat him like the muslim terrorist he is. Why should he get any comforts of pain meds, a comfy bed, and three hot meals a day? His victims didn't have the luxury of pain meds before they died. They need to move him into a jail asap and let justice prevail.

The death toll should be 14. I know one of the victims was pregnant, and in the state of Texas, if you kill a pregnant woman, your also killing their unborn child. Hasan murdered not only 13 people but 14. The unborn baby should be one of the death counts. Please do not forget about the baby.

Okay everybody, I agree that our constitution, the constitution obama hates, and of course this muslim terrorist hates, allows him a fair trial. Will he be tried by a federal court since this act occurred on federal property or will we see the same dog and pony show that is being played out by obama and the attorney general on behalf 0f the 9/11 masterminds? Let's face it, the U.S. is no longer a strong nation. The liberal democrats have destroyed our way of life and we can no longer depend on our leaders to protect us. Would obama care pay for this terrorists medical treatment? The answer would be yes. Would it pay for a triple bypass for a 75 year old American who fought for our constitution? The answer would be NO! WAKE UP AMERICA!!

Having served in the military, I know the defense of America and the American way of life is a power and responsibility far greater than fathomable by those who choose to live here without purpose. The constitution protects all, worthy or not. Would it be awesome to ship him off to the Taliban in Afghanistan in a powerchair or rascal? Hell yes! But due process is just what it is. Death will come for him, maybe not how he envisioned but it will come. And because he failed, life in the golden land will NOT be so golden. The chances of finding an impartial jury, slim to none especially amongst his peers. Perhaps the best sentence is life behind bars knowing that America endures.

Constitutional Rights or not, This guy did a 'Terroristic Act'(14 counts of premeditated murder, and 31 counts of premeditated attempted murder, and a Federal 'Hate' Crime on 'our' friendly soil, in front of a lot of witnesses. Either kill him in front of a Military Firing Squad, or have a Public Hanging!!! PERIOD!!!!!!!!!!

I agree with lukenbach. Let him be tried in Texas, not by the US military. It's been 50 yrs since someone has been executed by the military. If my memory serves be right, it's been less than 24 hours since justice has been done in Texas!!!!!! The only bad part about it is that he won't feel his death, but those he shot did!!! I say put him in front of a firing squad or hang him high....but open the door slow, we don't want to break his neck and he can't feel the upper part of his body while he's hanging!!!!

This should be his first and only hearing due to the fact that the entire nation knows that he is guilty. Any trial he goes through here anywhere in the U.S. is going to be biased on account of the nature of his crimes. He should be found guilty on 14 counts of 1st degree murder, 29 counts of aggravated assault with a deadly weapon and a count of high treason against the U.S. government. The only appropriate sentence for this terrorist is a summary execution by firing squad, to be carried out within 30 days after sentencing. I do believe that this is the only way to bring about some form of closure for the families of those who were killed or hurt by this terrorist. It is such a shame that he can't be tried by the state of Texas. I know that Governor Perry would most definitely see to it that justice was carried out appropriately for these kinds of crimes.

To "The Truth", I am not defending this mans actions in any way, but to say that the attorney is "non-American" may not be just. The attorney may be in the situation for publicity, but he could also be in it for another reason. The gunman is an American Citizen, who, by law is allowed a fair trial. He will be punished AND SHOULD BE. But if you completely ignore that fact and send him straight to the death chamber without a trial, who's to say that same right wouldn't be taken away from you or people you care about if they got into trouble. People claim to want to protect their rights, and live by the constitution, however; contradict themselves. This man killed our soldiers and on our land, and for this should be punished to the full extent, but you have to think about these things. That is the reason that the country is in the shape it is in.

What is the excuse here for intensive care.I think the people who are paying taxes need to know the exact reason.Otherwise, pre-trial confinment surely has an infirmary.Prayers to those who are wounded and the families of those who died on November 5th.
