SAN LUIS OBISPO, Calif. (July 9, 2010)--A year and a half after a freshman from Texas died of alcohol poisoning while pledging a fraternity at California Polytechnic State University, San Luis Obispo, two more former students have been sentenced to jail for hazing.

Adam Marszal, 23,of Carmichael, Calif., and Russell Taylor, 23, of Fresno, Calif., both pleaded no contest to misdemeanor hazing and apologized to the parents of Carson Starkey, of Austin.

Judge Linda Hurst sentenced them to 30 days in the San Luis Obispo County Jail and three years probation, waived their rights to appeal and ordered 40 each to perform hours of community service or to give two presentations on the dangers of alcohol and hazing.

Two other Sigma Alpha Epsilon brothers pleaded no contest to misdemeanor hazing in June and received similar sentences.

In September 2009, Scott and Julia Starkey filed a lawsuit against the Illinois-based fraternity and its local chapter over the death of their son.

Police say the 18-year-old student had to drink a bag full of alcoholic beverages as part of the pledging process.

He was found dead with a blood-alcohol level between 0.39 percent and 0.44 percent.

The lawsuit also named nine members of the suspended Cal Poly fraternity.

The Starkeys claim the fraternity should have taken further measures to prevent excessive alcohol consumption.
