A&M Student Struck, Killed By Train Was Legally Drunk

COLLEGE STATION (December 7, 2012)--A toxicology report from the autopsy performed on 19-year-old Texas A&M University student Garrett Luce shows that Luce had been drinking heavily before he was struck and killed by a train on Nov. 4.

The Travis County Medical Examiner’s Office found Luce’s blood alcohol content was 0.23 at the time of the accident, nearly three times the legal limit.

Medical examiners said Luce died of blunt force injuries.

“That’s pass out drunk for a lot of people,” said Dr. Boone Barrow of Scott & White Hospital.

College Station Police are investigating the accident.

Luce was a College Station resident and a sophomore at Texas A&M.

He was pledging the Kappa Alpha fraternity.

Union Pacific Railroad spokesperson, Raquel Espinoza, said the train's engineer saw something on the track from about a quarter of a mile away.

“The engineer sounded the whistle as soon as he realized it was a person on the tracks. The engineer put the train into emergency in an effort to stop the train, but the train was not able to stop before impact,” Espinoza in a phone interview.

Investigators said Luce was alone at the time of the accident.

“He was laying on the track. The train whistle was sounded two different times before the accident. He was not wearing earphones and should have been able to hear the train whistle both times. We just don't know why he didn't respond to those warnings,” said Espinoza.
