Charges Dropped Against One Man In Texas Campus Shooting

HOUSTON (January 28, 2013)--Prosecutors dropped assault charges Monday against one of the men who was in a shooting on the campus of a community college north of downtown Houston.

Carlton Berry was arrested soon after the shooting on Jan. 22 at Lone Star College and was charged with two counts of aggravated assault with a deadly weapon.

Berry was shot in the leg.

Sara Kinney, a spokeswoman for the Harris County district attorney's office, said Monday that Berry was clearly a victim.

Another man who was wounded in the incident told investigators that he bumped into Trey Foster on campus, sparking an argument that escalated into gunfire.

A maintenance worker was also wounded.

Foster, 22, was arrested Friday 250 miles away in suburban Dallas and was charged with resisting arrest and two counts of aggravated assault with a deadly weapon.

The resisting arrest charge stems from an earlier case, authorities said.
