Death Of Driver Whose Vehicle Struck, Killed 2 Texas Brothers Was Homicide

HOUSTON (December 12, 2012)--A medical examiner has ruled the shooting death of a driver after an accident in Alvin that killed two young brothers was a homicide.

A corner issued the preliminary ruling in the death of Jose Ines Banda, 20, who was driving a vehicle that struck a pickup that the two boys were helping their father push.

Brazoria County sheriff's investigator Dominick Sanders said Tuesday that the report also indicated Banda, who was shot in the head, had alcohol in his system.

David Barajas II, 12, and his brother Caleb, 11, were pushing the pickup with their father Friday night just yards from their home in Alvin when the car slammed into the truck, which had run out of gas.

David Barajas died at the scene and his brother died later at a hospital.

Their father was injured.

Authorities found Banda in the car with a gunshot wound to the head.

He later died at a hospital.

Initially authorities said it wasn’t clear whether Banda was driving or whether someone else was behind the wheel and fled after the accident.

Brazoria County sheriff's investigator Dominick Sanders said witnesses heard gunshots three minutes after the first 911 call about the accident.

No one has been named as a suspect in the shooting.
