Former Local Teacher Sentenced

A former Central Texas teacher who earlier pleaded guilty to injury to a child was sentenced Monday.

WACO (January 13, 2014) Former Hallsburg teacher Patricia Rush, who pleaded guilty in November to injury to a child in an agreement between her lawyers and a prosecutor for the Texas Attorney General's Office, was sentenced Monday to spend eight years on deferred adjudication probation, pay a $2,000 fine and perform community service.

The agreement reached in November also called for her to surrender her state teaching credentials.

Deferred adjudication probation means if she successfully completes the term of her probation she'll not have a final conviction on her record.

In December 2011 Rush was acquitted on 10 counts of an 18-count indictment that included aggravated sexual assault, indecency with a child and improper relationship between an educator and a student.

The jury reported it was deadlocked on the remaining eight counts, Alan Bennett, Rush's attorney, said at the time.

Bennett also said in subsequent weeks the state dismissed four of the remaining charges and Rush ultimately was charged only with two counts of aggravated sexual assault and two counts of improper relationship between an educator and a student remain.

The state, represented by Assistant Attorney General Lisa Hoing, had said it planned to retry Rush on the remaining counts.

The affidavit submitted for the original arrest warrant in 2007 said authorities started an investigation after a woman, who was not named, contacted the sheriff's office and told an investigator that her son, then 13, had been spending a lot of time with Rush and said she was concerned that the boy and Rush were "having a sexual relationship."
