Grand Jury Clears Officer In Texas Homeowner’s Death

FORT WORTH (January 30, 2014) A grand jury in Tarrant County has declined to indict a Fort Worth police officer who was involved in the shooting death of an armed homeowner.

The Tarrant County grand jury reviewed evidence Wednesday in the May 2013 incident involving Officer R.A. Hoeppner in which
Jerry Waller, 72, died.

Hoeppner was one of two officers who went were sent before dawn on May 28 to an east Fort Worth home on a burglary call.

The two officers ended up at the wrong house where they encountered Waller and shot him dead when he refused to drop his handgun.

The other officer involved in the incident, Officer Benjamin B. Hanlon, was fired in October for falsifying an arrest affidavit in an unrelated traffic stop.
