Grand Jury Declines To Indict Texas District Judge

DALLAS (February 20, 2014) A Dallas County grand jury decided Thursday not to indict State District Judge Carlos Cortez on an assault charge after a domestic disturbance in which his girlfriend says she was choked.

Cortez was arrested Dec. 28 on allegations he choked the 26-year-old woman, leaned her over the edge of the balcony at his apartment and threatened to kill her.

In a motion filed two days later, Cortez, 44, said the woman was trying to kill herself and he tried to pull her away from the balcony.

Cortez asked a judge to throw out an emergency protective order granted after the incident.

Cortez had been charged with family violence assault, a third-degree felony punishable by up to 10 years in prison.
