WACO (December 3, 2012)--Waco police arrested a local man early Monday morning on a warrant stemming from an incident in August in which shots were fired in the direction of Department of Public Safety troopers during a traffic stop.

Juan Dedios Martinez, 27, was ordered held in the McLennan County Jail Monday morning in lieu of $5,000 bond, charged with deadly conduct discharging a firearm.

He later bonded out Monday afternoon.

Waco police arrested Martinez just before 5 a.m. at a residence in the 2600 block of Ethel Avenue on the warrant, which was signed by McLennan County Justice of the Peace Kristi DeCluitt on Nov. 30.

Just after 2:30 a.m. on Aug. 26, DPS troopers made a traffic stop involving a possible drunken driver near South 9th Street and La Salle Avenue.

During the stop the troopers heard gunshots in the distance and then a loud thump as a bullet struck the patrol car.

At the time shots were fired there was one trooper standing outside the patrol car and one trooper and the driver were in the car, Trooper D.L. Wilson said.

Nobody was hurt.

Troopers later confirmed that the gunfire originated from near the intersection of South 14th and La Salle.

Investigators recovered what appeared to be a .45 caliber round from the patrol car and five spent .45 caliber casings from 1428 La Salle, where a Taqueria Mobile Taco Truck was parked.

During a subsequent search of Martinez’s home, investigators recovered a .45 caliber pistol, an arrest warrant affidavit says.

Martinez later confessed to shooting the pistol and, with another person, firing at the taco stand, and that person corroborated his account, the affidavit said.
