New Braunfels To Appeal Can Ban Ruling

New Braunfels has decided to appeal a judge’s ruling that struck down a ban on disposable food and beverage containers for tubers on rivers in the city.

NEW BRAUNFELS (March 25, 2014) The New Braunfels City Council has voted to appeal an order that overturned the city's ban on disposable food and beverage containers on rivers within the city limits.

In January Judge Don Burgess granted summary judgment to river outfitters and a beer distributor, who challenged the 2012 law and on Friday he signed an injunction that clears the way for disposable containers to again be allowed on the Comal and Guadalupe rivers.

City attorney Mick McKamie says the ordinance helped reduce litter and protect the rivers.

Critics challenged the city's authority and say the state regulates alcohol on public waterways.
