WACO (February 4, 2014) Just hours after one man was arrested in connection with an October 2013 capital murder, a second suspect was behind bars in connection with the same case.

The U.S. Marshal’s Task Force on arrested Texavia Rashun Ervin, 23, at 12:30 p.m. Tuesday in the 3200 block of north 25th Street.

Ervin’s arrest came the day after marshals arrested Danny Lee Byrd, 23, Monday afternoon in the 1900 block of Reuter Avenue on a capital murder warrant in the shooting death of Leslie David Lee, 44.

Byrd was held Tuesday without bond in the McLennan County Jail charged with capital murder in connection with the shooting death of a Purmela man outside of an apartment complex last October in North Waco.

Ervin was at the jail early Tuesday afternoon awaiting booking, a jail records clerk said.

Lee was shot to death at around 10:30 p.m. on Oct. 26, 2013 at the Lafayette Apartments at 2503 Ethel Ave. in Waco during a drug deal gone bad, Waco police Sgt. W. Patrick Swanton said.

Investigators determined that Lee and a woman went to the complex to complete a drug deal they had arranged when two men armed with handguns approached in what evidently was attempt to steal the drugs from the two, Swanton said.

Lee attempted to pull out his own handgun and was shot several times in the neck and face, Swanton said.

The woman, who was not identified, wasn't injured, Swanton said.

An autopsy was ordered.
