MCCAMEY (October 4, 2013)—Gary David Green, 50, who’s charged with capital murder in the shooting death of an Upton County sheriff’s deputy, remained hospitalized in critical condition Friday with gunshot wounds he received in the shootout in which the deputy was killed.
His bond is set at $1 million.
Sheriff’s deputy Billy "Bubba" Kennedy died late Wednesday at a convenience store in McCamey, about 50 miles south of Odessa.
Texas Rangers are investigating.
Kennedy was the second Upton County deputy to be killed in approximately a year.
Deputy Mike Smith died in June 2012 when his patrol car was struck by a tractor-trailer while he was en route to an emergency call.
