Texas Man Charged In Death Of Driver Who Killed His Sons

HOUSTON (February 11, 2013)—David Barajas, Sr., was in the Brazoria County Jail Monday, charged with murder in the shooting death of a suspected drunken driver whose car struck and killed Barajas’ two young sons.

David Barajas, Jr., 12 and his brother Caleb, 11, were helping their father push the family’s broken-down pickup truck in December when a car driven Jose Banda, 20, plowed into them just 50 yards away from the Barajas' rural Houston-area home.

Initially authorities said it wasn’t clear whether Banda was driving or whether someone else was behind the wheel and fled after the accident.

Brazoria County sheriff's investigator Dominick Sanders said witnesses heard gunshots three minutes after the first 911 call about the accident.

Authorities found Banda in the car with a gunshot wound to the head.

He later died at a hospital.

Barajas was ordered held in lieu of $450,000 bond.
