BROWNSVILLE (October 19, 2012)—The Texas Attorney General’s Office says a Cameron County prosecutor does not have to release video that shows police shooting a student to death in a middle school hallway in Brownsville in January.

The office ruled earlier this month that all records and documents pertaining to juveniles are confidential, even in cases in which the juveniles died.

Brownsville police officers shot Jaime Gonzalez, Jr., 15, an eighth-grader at Cummings Middle School, after he pointed what turned out to be a pellet gun at them and refused to put it down.

The Brownsville Herald reported Friday that John Bussian, an attorney representing the newspaper, said Abbott's office strayed from the Cameron County district attorney's argument that the video should remain private because no charges were filed in the case.

In August the Cameron County Grand Jury decided against charges in the shooting death.

Cameron County District Attorney Armando Villalobos said the grand jury found insufficient probable cause that the officers committed a crime.

A report released in February by the state attorney general’s office said a police sergeant gave the order to "take him out" when Gonzalez turned toward another student in a middle school hallway in January.

The report filed by Brownsville police said Gonzalez was holding a realistic-looking pellet gun when he turned toward the student who was trapped between him and the officers inside Cummings Middle School.

Officers shot Gonzalez in the abdomen and chest.

The report reflected earlier police statements that Gonzalez pointed the pellet gun at them, but also raised the possibility that he fired at officers.
