First Hearing For Accused Fort Hood Gunman Is Saturday

SAN ANTONIO (November 20, 2009)—Maj. Nidal Malik Hasan, the Fort Hood psychiatrist charged in the shooting rampage on Nov. 5 at Fort Hood, will have his first court hearing in his hospital room on Saturday, according to his attorney, John Galligan.

Galligan said Friday military prosecutors notified him of their plans for the hearing at the Brooke Army Medical Center in San Antonio.

Hasan has been recovering there since the shooting at Fort Hood’s Soldier Readiness Center that left 13 dead and more than 30 wounded.

Two civilian Fort Hood police officers shot Hasan.

The hearing will determine whether Hasan will be placed in pre-trial confinement, which usually means jail, but Galligan said he will argue that Hasan should remain in intensive care because he is paralyzed and still needs hospital care.

Fort Hood officials didn't immediately return a call about the hearing.

Meanwhile Friday, Democratic Sen. Carl Levin, chairman of the U.S. Senate Armed Services Committee, said after a briefing from Pentagon and Army officials that there may be additional e-mails that could have alerted law enforcement agencies or military officials before the deadly shooting.

Levin said his committee will investigate whether those and other e-mails involving the accused shooter were handled properly.

The government intercepted at least 18 e-mails between Hasan and Anwar al-Awlaki, a radical American- born cleric and they were passed along to two terrorism task forces led by the FBI, but defense officials have said no one at the Defense Department knew about the messages until after the shootings.

I don't see how he can get 'a fair trial'. There is not enough folks who have not seen the footage, read the news, etc. Then again, 'Fair' to me would more closely be to execute him immediately. He earned his death penalty by killing one. Shame we can't rinse and repeat 13 times. The victims are going to have to share their justice.

Anybody else see the cover of TIME magazine? And To all that say 14, I must agree. Give this muslim terrorist (is chairman Obama muslim?) a speedy trial and then bring back either hanging or firing squad. He doesnt deserve anything gentler. Yes, I am a firm believer in the death penalty and capital punishment. If convicted beyond a reasonable doubt, dont wait. Take them outside and kill them!!!

They need to stop treating him like a wounded victim and treat him like the muslim terrorist he is. Why should he get any comforts of pain meds, a comfy bed, and three hot meals a day? His victims didn't have the luxury of pain meds before they died. They need to move him into a jail asap and let justice prevail.
