Affidavit Says Murdered Boy Was Beaten To Death With A Belt
Police released more details Tuesday about the death of a 5-year-old Mexia boy and about the man and woman who were supposed to be caring for the boy and his younger brother, but who now are charged with capital murder.

LACY-LAKEVIEW (June 22, 2009)—Lacy-Lakeview police released more details Tuesday about the death of a 5-year-old Mexia boy and about the man and woman who were supposed to be caring for the boy and his younger brother, but who now are charged with capital murder and aggravated assault.

Andrea Thomas, 24, was arrested Monday evening in Waco while Christopher Mack, 22, was taken into custody in Limestone County where he was awaiting transfer Tuesday to the McLennan County Jail.

Thomas and Mack were caring Sunday for the 5-year-old boy and his 3-year-old brother, who are both from Mexia, when both boys were struck with a belt and the older youngster was seriously injured, police said Tuesday.

Mack, who’s also from Mexia, and is the boys’ uncle, “caused serious bodily injury” to both of his nephews, police said in a press release issued late Tuesday morning.

According to the affidavit submitted for an arrest warrant, Sinsear Kirvin was beaten with a belt and suffered bruises, abrasions and lacerations to his head, arms, front, back, and legs.

Mack originally claimed the boy had collapsed, but the affidavit says, “Upon further investigation, a witness stated that Mack began striking Sinsear) with a belt until the (Sinsear) passed out and was not moving.”

Thomas was also present when the incident occurred sometime before 11:30 p.m. Sunday at the apartment Mack and Thomas share on East Crest Drive in Lacy-Lakeview, police said, but made no effort to intervene or seek medical help, according to the arrest affidavit.

Mack got a ride to the Providence Health Center emergency room from a friend and took both boys to the hospital.

Sinsear was pronounced dead at the hospital and according to the arrest affidavit medical personnel told police he had been dead for an hour before he arrived at the hospital.

The 3-year-old’s injuries were not serious and he was treated and later released, police said.

The hospital notified police of the injuries.

Child Protective Services has taken custody of the younger boy, police said, and is assisting in the investigation.

Neighbors said two other children were also in the care of Mack and Thomas.

They were not believed to have been injured.

BEAT THEM WITH A BELT LIKE THEY BEAT THE LITTLE CHILD. LET THEM LOOSE IN POPULATION IN JAIL AND LET EVERYONE KNOW WHAT THEY DID TO THIS INNOCENT CHILD
