Waco Man Indicted In Hit-And-Run Death Of Bicyclist
A 35-year-old Waco man who was arrested after a vehicle whose driver was fleeing police struck and killed a bicyclist was indicted Wednesday.

WACO (November 18, 2009)—The McLennan County Grand Jury Wednesday indicted Marcus Cain, 35, of Waco for evading arrest/detention causing the death of another in a hit-and-run in October that left a bicyclist dead.
Cain was arrested after Joseph Lee Ray, 37, of Waco died in the early morning hit-and-run on Oct. 10.
Police said Ray was riding a bicycle east on Irving Lee Street when the driver of a Chevrolet Caprice that was southbound on the Interstate 35 frontage road ran a stop sign and the car hit him.
Police say the car’s driver had sped off moments earlier when an officer tried to pull him over for speeding.
The driver sped off after Ray was struck, police said.
Ray was pronounced dead at the scene.
Officers launched a search for the driver and for other people who may also have been in the car.
A helicopter was dispatched to join the search.
Officers later found the abandoned Caprice and one man in a drainage ditch in a nearby neighborhood.
Cain was arrested and charged with possession of marijuana, evading arrest causing a deadly accident and failure to stop.
His bond was set at $33,500.

Based on how things are now, criminal justic wise... he should also be charged with second degree murder, assault with a deadly weapon, vehicular homicide, involuntary manslaughter...
